QUICK NOTE on todays proceedings (until we get a proper legal journalists report) Longish hearing sorting legal details but Contracts wont be signed until after the end of August, more like September and October. Judge Croft requires a week to consider 3 questions revolving around the (missing) business case and whether they should be considered separately as suggested by the government and the LMA or concurrently as requested by Mr Anthony Murphys lawyers to which QC Ron Merkel then cited some 8 cases in support of this proposition. Questions revolve around whether the State was operating as a business and whether they had made/pleaded a proper representation, suggesting information had been misleading. The case is likely to proceed in two weeks as I take it over two days. A question of public interest immunity may be heard separately by another judge.
