READ THIS FOR TOMORROW EXPECTED JUDGMENT ( this court comes up tomorrow ) The Peoples Democratic Party and its national leadership have denied dissolving the executive committee of the party’s chapter in Ondo State. They said they had never stopped recognising the Ebenezer Alab-leadership as the state executive committee in Ondo State, which was purportedly dissolved by the party on October 26, 2014. The PDP and 12 of its national officers, who are defendants in the suit, stated this in a written address and a counter-affidavit both dated November 3, 2014, which they filed before Justice Sylvanus Oriji of a Federal Capital Territory High Court in Apo, Abuja. The party’s court papers were filed after the National Publicity Secretary of the party, Chief Olisa Metuh, had in a statement on October 26, announced the dissolution of the state executive committee and the constitution of a caretaker committee headed by Mr. Dare Adeleke. The defendants had filed the papers in opposition to an application by the former state executive committee members seeking “an order of mandatory injunction setting aside the purported dissolution” of the leadership of the PDP in Ondo State. But the defendants said the claims by the plaintiffs in their application dated October 27 were highly untruthful and misleading. The defendants’ written address filed by their counsel, Victory Kwon, in opposition to the plaintiff’s application reads in part, “On the contrary and significantly, the 1st – 13th defendants (PDP national leadership) have continued to deal with only the plaintiffs/applicants (Ebenezer Alabi-led exco) as regards to its activities in Ondo State. “Clearly, paragraphs 4(b), (c), (d), (g), (h) and (i) of the counter-affidavit not only contradict the surprising, highly untruthful and misleading depositions in support of its highly untruthful and misleading depositions in support of the plaintiffs/applicants’ affidavit in support of the application but demonstrates the 1st – 13th defendants/respondents’ continuous recognition of the plaintiffs/applicants as the state Executive Committee of the 1st defendant (PDP) in Ondo State.” The defendants’ counter-affidavit deposed to by an employee at the party’s national secretariat, Nanchang Ndam, read in part, “That on the contrary, the 1st – 13th defendants have only dealth with the plaintiffs/applicants to the exclusion of any other person as regards its activities in Ondo State.” The defendants are the PDP, and its 12 national officers, including the National Chairman, Mr. Adamu Mu’azu, the Deputy National Chairman, Prince Uche Secondus, National Secretary, Prof. Wale Oladipo, and Metuh. The Senate President, David Mark, and the Independent National Electoral Commission are the 14th and 16th defendants in the suit. The plaintiffs include the state chairman, Omotayo Alabi, his Deputy Chairman, Alhaji Fatai Adams, and his Secretary, Chief Oyedele Ibine. Others are three chairmen of the party at the local government level under the Alabi-led exco. The plaintiffs in its application accused the defendants of having engaged in “serial acts aimed at appropriating to themselves or destroying the subject matter of the suit.” They therefore urged the court to grant its application for mandatory injunction “declaring null and void and of no effect all steps, acts or things done by the caretaker committee pending the determination of the suit.” The court will on Friday hear the plaintiffs’ applications.
