REFUSAL TO WORK Under Section 15 “An employee may refuse to work or do particular work where he has sufficient reason to believe that- a) there is serious and imminent danger to himself or unusual circumstances have arisen which are hazardous or injurious to his health or life; b) (b) any machine, plant, device or thing he is to use or operate is likely to endanger himself or another employee; c) (c) the physical condition of the workplace or the part thereof in which he works or is to work is likely to endanger himself; d) (d) any machine, plant, device or thing he is to use or operate or the physical condition of the workplace or part thereof in which he works or is to work is in contravention of this Act or the Regulations made under it and such contravention is likely to endanger himself or another employee. Refusal to work does not mean that you are allowed to leave the compound of your workplace or refuse to perform any duties. It means that you must - 1. Report the circumstance (s) of refusal to work. 2. The employer shall have the health and safety committee investigate (no safety committee contact OSHA). 3. The employer can have you perform other duties that you are qualified or have the experience in. This does not apply to Fire Officers, Defense Force, Police Service and other personnel that do not work in normal condition eg: hospital, which you find in section 14 (2 a & b).
