Reason (a libertarian think tank) dug up a youtube video of ObamaCare designer Johnathan Gruber admitting what people have said all along: that the law passed by Congress prohibits tax subsidies in the federal exchange. Democrats and liberals in general have been trying to insist that the Halbig case was just a typo and that Congress (at the time controlled by Democrats) wanted individuals on the federal exchange to also receive the subsidies. This however is a lie as seen in the following video. The Democrats in their grand plan to make States knuckle under to ObamaCare set up the law to force states to accept the State exchanges. Unfortunately for the Democrats, the US Supreme Court ruled against ObamaCare a few years back and said that States had states rights and could reject the State exchanges. Since Democrats in Congress never conceived of this problem, it never occurred to them to write the law requiring that the federal exchanges also received tax subsidies. Enter the current Halbig suit where the DC Court of Appeals invalidated these federal subsidies. Democrats NOW insist that federal exchanges should obviously receive tax subsidies (not receiving them costs 5 million individuals $36 billion). One of the Architects of ObamaCare however laid bare the lie being passed around by Democrats in court. What’s important to remember politically about this is if youre a state and you don’t set up an exchange, that means your citizens dont get their tax credits—but your citizens still pay the taxes that support this bill. So you’re essentially saying [to] your citizens you’re going to pay all the taxes to help all the other states in the country. I hope that thats a blatant enough political reality that states will get their act together and realize there are billions of dollars at stake here in setting up these exchanges. But, you know, once again the politics can get ugly around this. - ObamaCare architect Jonathan Gruber (2012) So, all of this is really about the Democrats trying to force States to set up state exchanges, making it financially uncomfortable for them by forcing them to knuckle under to ObamaCare. Once the Supreme Court took that threat away, the Democrats changed tactics to try and re-write the law via regulation. They couldnt go to Congress because it was partially controlled by Republicans. So they went to bureaucrats to re-write the law in their own favor. The Democrats problem isnt just ObamaCare - it is that they are lying in court and pretty much everywhere else in an effort to get the ends to justify the means. Not surprising but still deserves to be said.
