Recently we have been receiving a lot of cases where sisters are approaching us to enquire about divorce. How can they leave an abusive husband? what are their rights? Do they have any rights? can she ask for a divorce if he doesnt want to? What does she do if there are children involved? What happens if he doesnt give a divorce? What does Islam say? Is it permissible in Islam? Why are we more bothered about preventing divorce than preventing domestic violence? We have 100s of talks about marriage and happy homes but what about the flip side. What about broken homes and what about divorce? Our deen is perfect and has come as a way of life, in its entirety, so surely we shouldnt be ashamed to discuss the less happy things which in reality do occur. Then, either keep [her] in an acceptable manner or release [her] with good treatment. [Quran; 2:229] Why do we never hear of this ayah? Why do things get so ugly? Unfortunately divorce is a reality that occurs, and sometimes is a necessity to leave an abusive home and flee from danger. So how do we go about this? Divorce does exist in Islam and it is not haram to talk about it, infact it is healthy to talk about it in the correct manner. We will be holding an event in the new year by the will of Allah, to address all these issues, working with a Shariah council to explain in the light of Quran and Sunnah .
