BRIEF FACTS OF THE CASE: 1. This is an investigation conducted by this office, SMMCIDT, NCR CIDU, CIDG under the supervision of Special Investigation Task Force KAE headed by PCSUPT CHRISTOPHER LAXA relative to the death of KRISTELLE DAVANTES y MORINES @KAE, 25 years old, sinlgle, Senior Account Executive of MCCANN World Group and resident of No.13 Apollo V, Moonwalk Subdivision, Las Piñas City who was found dead by Silang, Cavite Police with various stab wounds, hands and feet were tied up with cord and seat belt at the vicinity of Tibagan Bridge, Silang, Cavite on or about 7:00 a.m. of September 7, 2013. 2. On that fatal day of September 7, 2013, an ocular inspection/investigation was conducted at the scene of the crime where the dead body was found by the joint teams from SOCO, PNP Crime Laboratory Group and the Silang Police Investigators and then the victim’s cadaver was brought to Aguinaldo Funeral Homes in Silang, Cavite for Autopsy and Post Modern Examination. Based on the SOCO Examination, the cause of death of the victim was due to stab wounds: neck asphyxia, consistent with strangulation. (Attached are After SOCO Report dated September 7, 2013, the Certificate of Death of Kristelle Davantes, Information Report from Acting Chief of Taguig City Police Station and the Spot Report from Silang Police Station, Cavite); 3. On September 12, 2013, Investigators of this Office led by SPO3 Florentino DC Tasarra was instructed by PCI Romeo Nino to proceed to the residence of the victim at No. 13, Apollo V, Moonwalk Village, Las Piñas City. Upon Arrival at the said residence, the team was able to talk to the family of the victim and took the individual statements of Mr. Vicente Davantes and Ella Morines as the complainant representatives for the family. Further, the boyfriend of the victim identified as one Benedict Ong y Lim who was presented thereat also gave voluntary statement. (Sworn Statements of Vicente Davantes, Ella Morines and Benedict Tan are hereto attached); 4. On the account of the statements given by the above-named complainants and witnesses, it appeared that in the morning of September 6, 2013, victim Kae Davantes drove her Toyota Altis car color beige bearing plate number PIM 966 to report for work at MCCANN World Group with office address at 5th floor, Active Fun Building 28th Street BGC, Taguig City. She was supposed to be at home that night, however the said victim never returned home and nowhere to be found. Worried of the situation, they exerted effort to find her not until on or about 9:00 a.m. of September 7, 2013 they received a phone call and email picture from a high school classmate of the victim that Kae was reported found dead in Silang, Cavite. 5. On or about 11:50 p.m. of September 15, 2013, the victims vehicle, Toyotal Altis color beige bearing plate number PIM 966 that was slightly burned was recovered abandoned along Nickel Street, Camella IV-A Pamplona 3, Las Piñas City. Mr. Alfredo Ilagan Jr., said that before midnight of that date when the vehicle’s alarm sounded and smoke were coming out from the vehicle. He sought assistance to PO3 Abdul Gani Tedding and Batangay Tanod Charlie Cagay stationed several blocks away from his residence. Investigators of this office, SPD SOCO team and Las Piñas Police Investigators conducted Crime Scene Investigation at the scene where the vehicle was abandoned and during the processing when the vehicle was opened, it was found-out that all the seats, seat belts and floor matting were gone, a diesel fume emanates from the vehicle and the glove compartment was burned. Also, several clothing as well as the sidings, panel board and ceilings were found soaked believed to be of diesel fuel. Likewise found inside the vehicle where two (2) 1 liter ZOILO diesel oil plastic containers. Thereafter, said recovered abandoned car was brought under the custody of this office for proper disposition as evidence. Upon further verification, the car was registered in the name of MERCEDES M. ILANO (Xerox copy of the Certification of Registration and Official Receipt of the motor vehicle bearing plate number PIM 966 hereto attached as Annex “H” of and later found out to be sold out to Kristelle Davantes. (After Activity Report Re: Abandoned Vehicle dated September 15, 2013 submitted by PCI JOSELITO S. SAVARES of SPD SOCO is hereto attached); 6. On September 20, 2013 (Friday), agents of the NBI arrested one of the suspects identified as SAMUEL DECIMO. In the news, said suspect disclosed that he was the one who tied the victim with seat belt and killed victim with the use of a computer cord, and stabbed her with a bladed weapon. Said suspect still remain under the custody of the NBI Investigators up to this filing; 7. On September 22, 2013, one of the suspects identified himself as REGGIE DIEL Y GALVAN, 30 years old, married, and resident of Villa Esperanza, Molino Dos, Bacoor, Cavite voluntarily surrendered to SITG KAE under PCSUPT. CHRISTOPHER LAXA and thereafter was turned-over to this office for proper disposition and investigation. At this office, above-named suspect voluntarily gave his sworn statement assisted by his counsel ATTY. PABLO B. AJESTA, PTR No. 7547112/QC/1-2-13, IBP No. 842589/QC/1-2-13, Roll No. 34661 and MCLE No. III-0018042.00 the sworn statement was taken by investigator, SPO3 Florentino Tasarra. Based on his sworn statement he was one of the members of the band of six (6) malefactors who participated in the commission of the crime where in his sworn affidavit he confessed that they took Kristelle Davantes at gunpoint, took the wheel of the car, stole the personal belongings of the victim and then killed the victim. He identified his cohorts as JOMAR PEPITO @Jomar, JOREK EVANGELISTA @JOREK, @LLOYD, @BASER, @DECIMO and him. (Sworn Statement of Reggie Diel y Galvan is hereto attached); 8. During follow-up operation by the investigators of this Office under the supervision of the SITG, the team was able to trace the registered owner of the vehicle used by the suspects described as on Honda Civic color red bearing plate number NYO 517 (get away MV) which was seen at the CCTV footage of Moonwalk Village Las Piñas City. The said described motor vehicle was voluntarily surrendered by the registered owner identified as one SHEILA MARIE VILLA a.k.a. @Lala, residing at #114 Ligas 1, Bacoor, Cavite. Said car owner was invited accompanied and assisted to this office by Barangay Kagawad Modesto Dela Cruz together with the car which was brought to his office and was later remain under the custody of this office as evidence relative to the crime. As this office, Ms. Sheila Marie Villa was investigated and through the assistance of Kagawad Dela Cruz, she gave her free and voluntary statement to investigator SPO3 John Baligat of this Office and she narrated that she is the live-in partner of one of the suspects, Jomar Pepito @Jomar and they are living together at #114 Ligas 1, Bacoor, Cavite. She further averred that on the night of September 6, 2013 her live-in partner left their abode and barrowed her owned car, Honda Civic with plate number NYO 517 without knowledge of his destination. However, at about 6:00 in the morning of September 7, 2013, she saw her car was already parked at their residence. Furthermore, in her sworn statement, SPO3 Baligat presented to her pieces of clothes that were extracted from the victim’s car and she positively identified some of these garments as her own and some are clothes of her daughter. (Sworn Statement of Shiela Marie Villa is hereto attached); 9. On or about 4:00 p.m. of September 21, 2013, Saturday, one of the suspects identified as LLOYD BENEDICT ENRIQUEZ, 18 years old, single, resident of Villa Esperanza, Molino 2, Bacoor City, Cavite was arrested by them at Garcia Compound, Purok 1, Cupang, Muntinlupa City. Above-named suspect was turned-over to this office by PSINSP ROMEO VASQUEZ together with the arresting officers PO2 Reynold S. Aguirre and PO1 Pedro B. Delgado of the Muntinupa City Police Station Intelligence Unit, Muntinlupa City on or about 2:15 a.m. of September 23, 2013. It recorded in the official blotter of this office with entry number 2203 page 0832. He voluntarily executed his Extra Judicial Statement as assisted by his lawyer Atty. Pablo Ajesta at this Office. In his sworn statement, he also admitted his participation in the gruesome crime together with other identified suspects; 10. After careful evaluation and analysis, it was found out resulting from inescapable conclusion that the instant case is a well-coordinated “hit” in ordinary parlance or a treacherous attack leading to the death of victim, Kristelle Davantes y Morines perpetrated by unequalled six (6) malefactors in concert and in grave conspiracy with one another leading to the preparation of this heinous complex crime of Robbery with Homicide and Qualified Carnapping. 11. Please be informed that the arrest of LLOYD BENEDICT ENRIQUEZ y BULAK a.k.a. @Lloyd of the Muntinlupa Police and voluntary surrender of REGGIE DIEL y GALVAN, a.k.a. @Jojo in the afternoon of September 21, 2013 (Saturday), follow up operation was conducted by the operatives of the SITG KAE for possible arrest of other suspects implicated by the aforenamed suspects. However, due to increment weather from September 21, 2013, September 23, 2013 (Monday) and the suspension of work in government offices, caused by flooding in Metro Manila, the said operation was hampered, hence the failure to arrest the remaining suspects who were still at large as of this inquest. This case will be presented by SPO3 Florentino DC Tasarra, Investigator On-Case. BERMAL, JR., and PO2 FELIX T. LAZARTE III, all members of the Philippine National Police and assigned at Intelligence Unit of Las Piñas City Police Station, after having been duly sworn to in accordance with law do hereby depose and states; 1. That, we were tasked to track/monitor the whereabout of the suspects in the killing of Ms. KRISTELLE “KAE” DAVANTES, who was found dead under Tibagan Bridge, Barangay Sabutan, Silang, Cavite around 6:00 AM of September 7, 2013. After series of follow-up operations, an information was received by PSSUPT. ADOLFO B. SAMALA, Acting Chief of Police of Las Piñas City Police Station, Southern Police District, on or about 10:00 PM of September 24, 2013, that the fifth member of the group who victimized Ms. Davantes identified as one KELVIN JORIC EVENGELISTA y TELBA, 19 y/o, out of school youth, jobless, and a resident of Brgy. San Nicolas III, Bacoor Cavite, is trying to coordinate with the police force who can help him surrender peacefully and that can assure of his security and safety. Immediately, PSSUPT SAMALA tasked us to form a team and verify the said information and find the person who can negotiate for the surrender of the suspect. After diligent effort, it was found that Mr. RICARDO EVANGELISTA was one who send messages and sought our help for the possible submission/surrender of his son KELVIN JORIC T. EVANGELISTA. 2. That, on the same date, Mr. EVANGELISTA personally appeared to the office of PSSUPT. SAMALA and revealed the location of his son after our Acting COP guaranteed the safety of his son if the latter surrender. 3. That, after briefing from PSSUPT. SAMALA, we together with Mr. EVANGELISTA immediately proceeded in Cabanatuan City to fetch his son who was going to Maria Aurora, Aurora Province with his mother and two brothers. And fortunately, when we reached the Cabanatuan Bus Terminal at about 2:30 AM, of September 25, 2013, a teary eyed mother of KELVIN JORIC carrying two kids appeared and called his husband Ricardo Evangelista then pinpointed the location of their son who also emerged in a brown sweatshirt with a hood that covers his head and approached us. After apprising of his Constitutional Rights and a simple conversation with the surrendered suspect to establish a good rapport was made by us. We, then proceeded to Cabanatuan City Police Station to put into records/police blotter the voluntary surrender of KELVIN JORIC T. EVANGELISTA. Thereafter, we proceeded to Las Piñas City Police Station for investigation and appropriate action. Likewise, he was medically examined at the Las Piñas City Health Office and subsequently turned-over to SPO3 John Baligat od SMMCIDG, CIDG-NCR at around 5:00pm of the same date. PCI MARLO S. AFFIDAVIT I, the undersigned, of legal age, bonafide member of the Philippine National Police, Criminal Investigation and Detection Group currently assigned as Provincial Officer at Cavite Criminal Investigation and Detection Team (CAVCIDT), Rescue 161 Building, Imus Civic Center, Imus, Cavite after having been sworn in accordance with the law do hereby state; That, our Office is a member of Special Investigative Task Group (SITG) “KAE” wherein we are investigating the killing of KRISTELLE DAVANTES y MORINES, nickname “KAYE”, female, 25 years old, single, Senior Accountant in Mc Cann World Group Philippines and residing at #123 Apollo 5, Moonwalk, Las Piñas City. The victim was found dead at under the Tibagan Bridge, Barangay Sabutan, Silang, Cavite on September 7, 2013 at around 6:00 in the morning with multiple stab wounds and strangulation marks on the neck. That, on September 24, 2013 at around 5:00 in the afternoon, we were informed by Cavite Governor JONVIC REMULLA and Congressman JON-JON FERRER that one of the alleged suspects in the killing have voluntarily surrendered and wishes to face justice. That, at around 5:45 PM of same date, Governor Jonvic Remulla and Congressman Jon-jon Ferrer personally turned over to the undersigned one JOMAR PEPITO y ERLINDA, 23 years old, single, driver and a resident of Verdant Subdivision, Las Piñas City. That, upon interview Jomar Pepito readily admitted to the undersigned his involvement of the crime. He further averred that after the crime he hid himself at Tamacan, Amadeo, Cavite but his identity was discovered during the investigation which prompted him to surrender with aid of Amadeo ABC President RADING VIADO who is turn turned him over to the Provincial Capitol, Trece Martires City. That, due to his revelations to the undersigned, the subject person was brought to our Office for proper documentation and further disposition. That, I executed this affidavit to attest the truthfulness of foregoing facts and to support the filing of necessary charges against the respondent.
