Response to Hurricane Cargo statement via the BBB that I am - TopicsExpress

Response to Hurricane Cargo statement via the BBB that I am Unreasonable. You say I am unreasonable, that picture do not mean anything. You say I must bring the trailer to you or you do not have to repair it. I respectfully ask you to read the Hurricane Cargo warranty information on the Hurricane Cargo Warranty Web Site. I included the part that says a Trailer can be repaired at an out side facility. I had picked up the trailer I would bring it back to you. But the trailer was delivered in the condition it is currently in. As stated in your terms and Conditions; rejecting the trailer as means forfeiting my deposit. Your delivery acceptance form say I should list all concerns, I did. Now let’s put time line and history on this trailer. I ordered the trailer under the condition and guaranty by the sales person that I would have the trailer by April 13. I need to use the trailer on April 17th. I called prior to April 13 because I had not head from anyone that the trailer was completed and was told the trail was delayed. By 2 weeks, then told it was completed two weeks ago and no one picked it up it was sitting in your yard. I was then promised I would have the trailer by April 15th. I re-arranged my trip cutting days off so I could get the trailer that never showed up. I was told the trailer would be delivered to me April 20th at my event location, it was not. I was stuck with no trailer and extra hotel cost waiting for the trailer which was delivered April 22nd. With the defects listed below. I listed as many of these defects on your Acceptance form as possible. I was stuck 350 miles away from home with my family my truck and a car I had no way of getting home until the trailer arrived. A clear failure on the part of Hurricane Cargo not me, I was pro active trying to get the trailer delivered on time and for good reason. I tried calling Hurricane per your Terms and Conditions but as you know full well, it takes days of calling non stop before a person is lucky enough to get a live person to talk to. I filed a warranty request right away no delays. In fact I filed 6 warranty request sent over 60 pictures and called several times a day for weeks trying to get some one to talk to. Calling Hurricane gets you a recorded message that states the mail box is full and not taking messages try again. Fact, in order to speak with a live person at Hurricane Cargo we had to use phones that were not ours. It appeared you use caller ID to not answer call from people who are existing customers. When I did get to leave a message I never got a return call, the few time I did get a live person they promised to look into this situation and get back to me but never did/ do. So back to the trailer condition, you talk about the outer and inner skin and say I am making a big deal of nothing, but you fail to address the rest of the issues listed below. *_________________Readers Please Note_________________________* *So how about we let a certified trailer repair facilities inspect the trailer?* I have per the suggestion of a hurricane worker taken the trailer to a certified repair center, I informed Hurricane of this, and supplied the centers name, address, phone number via phone mail and email and still weeks later have not heard back from you.* *The repair center has tried to contact Hurricane Cargo only to get the same recoded message I get stating the mail box is full and not excepting messages try again later.* (As of June 20 2013 Hurricane Cargo has failed to give them an answer) *Let us see what they say; surely if I am just as you say a “VERY unreasonable customers” Then you have nothing to worry about. But if the issues with the trailer are legitimate problems that need to be repaired then you make the repairs, send me a new trailer or refund my money.* (Micheal Gatewood said he does not what my opinion of what I think is wrong he wants to know what is really wrong, Yet he continues to refuse to agree to having a third party inspection of the trailer. Maybe he knows what the outcome will be.) *___________________________________________________________* Personnel this “VERY unreasonable customers” likes the trailer that is why I went with it and I would like to keep it. But Need one I can use. If this trailer is an example of what you consider a quality built trailer. Then your idea of quality is different then that of the rest of the world. Ramp that you can not drive the car up without tearing into and gouging the ramps, and damaging the car? Spear tire mounted so that it MUST be removed when loading and unloading a car to prevent it from damaging the car? Interior cabinet doors with hinges that are sagging because the hinges had to be bent in order to let the door close because the frame work or doors are not square, not cut correctly? Sharp edges that could puncher tires rip hand/ finger open? Aluminum plating cut short leaving gaps? Bolts or something not fully tightened before the aluminum sheet plating was laid, causing large protrusion that will over time break though the aluminum and or just break or come loose. I say let a certified repair facility determine if I am “VERY unreasonable customers” or a customer that received a trailer in need of repair. If I am then I will go away, if I am not then make the repairs. I received this trailer Monday April 22, 2013 11:45am the issues listed below existed when I received this trailer. Here is the list of workmanship defects. 1. Ramp right side front, sharp edge bent out of shape, looks like no support under aluminum. 2. Ramp right side rear, push up looks like it can puncher tire. 3. Rear outside, Bottom drivers side trim bent out. 4. Ramp left inside aluminum siding is loose, edge pooped out in more then a few places. 5. Ramp right inside aluminum siding is loose, edge pooped out in more then a few places. 6. Both door, springs have removed paint & put groves in doors. 7. Escape door latch rivet broken with sharp edge, this is a safety issue as well as it is sharp and in a spot were it can cut someone hand open. 8. Doors on upper cabinets not square, and doors are loose, it looks like the hinges were bent so the door would close, doors sag, are sloppy and wobbly and are unexceptionable. 9. Jack foot missing, no foot plate. 10. Surge unit not fastened to trailer bolt head broken unit dangling; should be check to verify it works correctly before fixing. 11. The ramps are not correct; the car bottoms out EVERY TIME it is loaded and unloaded. The car is digging into the aluminum ramp and scarred it as well as smashed it; not to mention what it did to my car. The aluminum ramp is to high at the point where it starts to level out and is now a bit deformed due to loading the car in just once. 12. It looks as if there are screws or blots under the aluminum on the ramps that were not fully tightened down causing bumps in the aluminum when it was laid down and secured in place, both side. it is only a matter of time before they will break through the aluminum. 13. The spare tire is incorrectly mounted, if left in place the car mirror hits it when loaded or unloading, it MUST be moved to the front to prevent damaging the car. The tire is mounted as high as it can be and should have never been mounted in the rear of a trailer that has ramps. 14. The right out side where the upper black panel meets the lower aluminum is popping out and no longer flush you can actually walk the length of the trailer and push section back in it is very obvious. The whole right side now looks like a wavy wrinkled sea of black. The seams on the top of the trailer right side are pulling apart and no longer sealed or water tight. The inside roof and right side wall look honorably distorted the seams are all pulling apart and I can see the inside. I have an event scheduled May 11th, and need to get this fixed ASAP. Today is April 30, 21013 to date we have not received we have not received any reply From Hurricane Cargo: As it stands according to your warranty I can not use the trailer if using it causes more damage. The following is from the paperwork I received from the sales person: WHEN YOUR TRAILER ARRIVES IT MUST BE SIGNED FOR BY THE PERSON WHO ORDERED THE TRAILER, YOU WILL BE REQUIRED TO SIGN A FORM AGREEING THAT THE TRAILER IS BUILT CORRECTLY, AND AS DESCRIBED, AND THAT YOU ACCEPT IT AS IT IS. IF THIS FORM IS MODIFIED OR NOT SIGNED THE TRAILER WILL NOT BE LEFT. ACCEPTING POCESSION OF THE TRAILER MEANS YOU ACCEPT IT AND AGREE THAT IT IS BUILT AS DESCRIBED. WE DO OUR BEST TO MAKE SURE THAT YOUR TRAILER IS BUILT EXACTLY TO THE SPECIFICATIONS LISTED ABOVE. ON REQUEST, WE WILL SEND PICTURES SO THAT YOU CAN VERIFY THAT THE TRAILER IS CORRECT. * note this part then refer to the call our phone call logs)* ON THE RARE OCCASION THAT THERE IS A PROBLEM WITH THE TRAILER AT THE TIME OF DELIVERY, YOU MUST CONTACT A REPRESENTATIVE OF Enclosed Trailers For Less WHO WILL WORK WITH YOU TO RESOLVE THE ISSUE, WHEN YOU ACCEPT THE TRAILER, YOU ARE AGREEING THAT IT IS CORRECT AND/OR THAT THE RESOLUTION WE HAVE AGREED TO IS ACCEPTABE. DO NOT ACCEPT THE TRAILER IF YOU ARE NOT HAPPY WITH THE TRAILER OR THE RESOLUTION TO ANY PARTICULAR ISSUE. Again it is impossible to adhere to this when Hurricane Cargo uses a recorded messaged that will not let you leave a message and when it does Hurricane Cargo fails to follow up. The following is from your warrant site hurricanecargo/index.php/warranty.html Outside Repair Facilities This warranty specifically requires the product to be returned to the factory for warranty repairs and the following sections should not be construed as an obligation or comittment by Warrantor in any way. *note this part of the warranty as posted on the Hurricane Cargo warranty web site* In some cases Warrantor will make arrangements for repairs to be made at an outside or independent service facility. Should Warrantor elect, AT ITS DESCRETION, to allow repairs to be made at an outside service facility the purchaser will be required to pay for the first $100 of the repair. In these instances repairs should only be made when the purchaser and repair facility have been given written permission by Warrantor. Warrantor will not reimburse or pay for unauthorized repairs. *(In contrast to what Micheal Gatewood told the BBB in his reply to the complaint, "Warrantor will make arrangements for repairs to be made at an outside or independent service facility." Did Micheal Gatewood lie in his reply statement to the BBB or is his Official warranty statement a lie?)* The following is a schedule of maximum amount Warrantor will pay for specific repairs, should it decide to allow an outside repair(note: this is the max amount Warrantor will add to the original purchasers $100 deductible: Axle placement issues- $200, lighting issues - $200, roofing issues - $300, exterior sheeting issues -$300, structural/welding issues $300, Exterior Screw less sheeting issues - $200. At No time during the warranty period will the warrantor pay for any outside repairs that exceed 10% of the original purchase price of the trailer. We have gotten to this point, involving the BBB because of the out right failure on the part of Hurricane to respond to calls emails and warranty request forms filled on the Hurricane Cargo web site all in accordance to Hurricane guild line. Since the trailer was delivered in the condition it is currently in, and the condition was documented upon receipt as required, and because of the distance and the lack of communication on the part of Hurricane Cargo prior top delivery and upon delivery; I am respectfully asking that you approve a local repair facility which you can do in accordance to your own warranty condition posted the official Hurricane Cargo Warranty Web site, to make required repairs. I will pay my required part. This is not an unreasonable request I have explained To Ben, Kevin, Amanda and the Hurricane Human Relation people from the very first attempts to contact Hurricane Cargo that communication is all I am asking for. When you say you are going to call me back, call me back, don’t’ force me to keep calling all day long for days until I get a live person. I have dated call logs, copies of all the warranty requests forms I filled and the acceptance paper work that I had photo copied because of the condition of the trailer was in, available upon request, but you already have the trailer paper work. As I said earlier, I went with this trailer because if fit my needs and I truly did and still do like it. It really is the best fit for my needs. I would be happy to have it repaired as long as it is correctly repaired, or if you want to replace it fine, all I want is a trailer I can use and functions correctly, cabinet doors that will close without manipulating them etc. Again here is the Trailer repair facility I found in XXXXXX XX.
