Robert Bertling...Interesting little tidbit about the Brown case. It has been stated by law enforcement officials that officer Wilson did fire 2 shots (both missed according to officials) at Brown as he was fleeing. It surely cant be reasonably assumed that Mr. Brown posed a threat to the officer or to the public as he was fleeing, as the officer had no reason to believe that he was armed or that he would commit another crime to the public. Wouldnt this be a violation of his fourth amendment rights (Tennessee v. Garner)? Its stated by officers and by witnesses that Mr. brown stopped after the two shots. He, more than likely (reasonable assumption?) wouldnt have stopped had the officer not fired his weapon. Would this not put into question objective reasonableness of the deadly force that followed? I mean, it more than likely wouldnt have happened if the victims 4th amendment rights had not been violated in the first place. Its an interesting twist none-the-less.
