Ross attended a seminar on recent developments in Personal Injury Law and Practice. The seminar focused predominately on the changes to health and safety personal injury law brought in by the Enterprise and Regulatory Reform Act 2013. “The seminar gave an extremely useful insight into the different methods now required to make a successful claim for health and safety accidents which have occurred on or after 1 October 2013. Discussed were the implications for both pursuers and defenders when dealing with a claim with particular attention to what is required of the pursuer now that they can no longer rely on the so called six-pack regulations. We were made aware of the importance of the common law tests and the best way to frame our averments when drafting our written pleadings. We also picked up some useful tips on statutory framework which can still be used in certain cases, the best evidence to use to satisfy the common law tests and how crucial the use and quality of risk assessments will be. It was also highlighted that although there was now a greater demand placed on the pursuer in order to make a successful claim, there is still a large scope for legal jousting and defenders will not be able to have it all their own way!”
