SC asks Times Now to deposit Rs 100 crore before HC takes up its appeal in defamation case TNN | Nov 15, 2011, 04.29AM IST inShare 15 NEW DELHI: The Supreme Court on Monday declined to relax a Bombay high court order asking Times Now TV channel to deposit Rs 100 crore - Rs 20 crore in cash and the rest as bank guarantee - before taking up its appeal against a trial court verdict in a defamation case. Former Supreme Court Judge, Justice P B Sawant, had sued Times Now for mistakenly displaying his photograph in a report on September 10, 2008, about a person (with a phonetically similar sounding name) allegedly involved in the multi-crore Provident Fund scam. A Pune trial court had decreed the suit for Rs100 crore against the TV channel. Times Now had appealed against the trial court verdict, but the Mumbai HC in September this year had asked the TV channel to first deposit Rs 20 crore and provide Rs 80 crore as bank guarantee as a pre-condition for hearing the appeal. Appearing for the TV channel, senior advocate Harish Salve said the channel had apologized for the mistake and had run an apology for five continuous days and requested the apex court to relax the stiff condition of depositing Rs 100 crore as a pre-condition for appeal. A bench of Justices G S Singhvi and S J Mukhopadhaya declined to grant relief to petitioner Times Global Broadcasting Company Ltd, which owns the TV channel, saying there was no error in the high courts interim order. We find no reason to interfere with high courts order directing the petitioner to deposit Rs 20 crore and furnish bank guarantee for the rest, the bench said. However, the bench clarified that the HC would decide the appeal on its merit without being influenced by the apex courts decision to dismiss the appeal against the pre-condition of depositing the amount. When contacted, Times Now channel head Arnab Goswami said, We are extremely apologetic to Justice Sawant for the mistake and any personal damage done to his reputation because of the inadvertent error of running his picture instead of another judge. The picture ran for only about 15 seconds, and was a genuine oversight in the course of a broadcast. Time to time I have brought these facts through my 10 complaints before Hon’ble Chief Justice of High Court,Mumbai as regards huge corruption made by judicial officers causing grave injustice to me. But till today on my repeated enquiry about my complaint dt. 1.8.2012 against corrupt magistrate at Dahanu, no reply is given to me. I have also placed all the evidence of landed property owned & possessed by me. I brought to the kind notice of Hon’ble High Court through my affidavit ,the false,forged & fabricated revenue record of my land made by builder in conspiracy with revenue department at Dahanu and obtained the illegal order within 4 months by fraud on court in criminal conspiracy with advocates and magistrate at Dahanu,without making me a party. But on 10.6.2014 Hon’ble High Court has also dispossed off the Cr.Writ Petition No.2037/2014 by denying me the opportunity to be heard , which compelled me to protest by fast as complaint to Hon’ble C.J. has also not considered my genuine grievance. After my fasting before the High Court on 26.6.2014, I was heard & said Cr.Writ Petition is restored, but now dates are given without any reason. 4 mins · Like Roshani Bafna 3) I have also brought the facts before the court that I have no source of income except said landed property as whatever amount bequeathed by my late mother has been invested in the year 2003 but the said investment is also misappropriated and cheated by habitual offender Motilal Oswal ,a chairman of Motilal Oswal securities Ltd. and another builder Ramniklal Shah and Natwarlal Shah at Dahanu. In the said cases also corrupt magistrate at Dahanu have played a vital role to support said multimillioner accused .All the evidence I have placed on my affidavit before Hon’ble High Court. All these facts I brought before Hon’ble Chief Justice of High Court,Mumbai & urged to decide the cases pending before Hon’ble High Court,Mumbai on merit, expeditiously. But all the time except dates after date no justice is given to me by courts, thus since last 11 years I was made to run from pillar to post .By complaint dt.19.9.2014 ,and complaint dt.30.9.2014 I again reminded these facts to Hon’ble Chief Justice, Hon’ble Registrar General and Judicial Registrar of Bombay High Court and urged to direct concerned courts to decide the said cases on merits expeditiously and judiciously as Hon’ble High Court has already given 55 dates without any reason in cheque bouncing case which required to be decide without any delay as per law. On 8.10.2014 Hon’ble Justice Smt.Sadhna Jadhav has assured me that on 27.10.2014 she would certainly hear my case of cheque bouncing, but I am pained to say that the registrar has not placed the said matter on board on 27.10.2014 and the court has denied my application for production of papers best reason known to them. Thus it is the wilful judicial negligence with ulterior motive to protect the accused and to harass me.The copy of long list of dates by Hon’ble High Court in cheque bouncing case is herein annexed for Your Lordships kind perusal which certainly proved the malafide and ulterior motive of Hon’ble C.J. of Bombay High Court to protect the multimillionair accused. Even in another case of cheating and misappropriation of my investment by multimillionaire Share Broker Motilal Oswal & his sub-broker, the registrar has flouted the directions dt.23.9.2014 given by Hon’ble Justice Shri Taheliyani to place the case being No.268/2014 for hearing on 28.10.2014. I am pained to say that by letter dt.27.10.2014 to the registrar of High Court I have specifically urged , but the said matter is not placed on board for hearing best reason known to them. Thus corrupt officers are harassing me at the cost of contempt of court and the facts brought before Hon’ble Chief Justice by me have conveniently avoided to look into genuine grievance best reason known to them.I am pained to say that the Bombay High Court has also shown dustbin to the letter dt.5.9.2014 sent by the Law & justice department , Delhi directing to take action. Thus it appears to me that corruption in lower judiciary has reached to its height and some corrupt officers have became heartless to hear any genuine grivence of common people. Thus after huge suffering from grave injustice at the hands of corrupt judiciary I have decided to end the life by fasting till my death by peaceful protest against said grave injustice on me. 1 min · Like Roshani Bafna 4) I must point out the fact that earlier also I became the victim of injustice at the hands of then Chief Justice of High Court ,Bombay who in the year 1994 blindly & illegally directed me to vacate my one room of shelter at my matrimonial house situate at Shivaji Park,Mumbai which was awarded to me by final order & Judgement dt.21.8.1992 in FCA No.37/1992 with separate entrance and with direction to my husband and in-laws not to interfere in my stay as they found cruelty on wife for dowry. I am pained to say that said corrupt Chief Justice Shri Bhattacharji was caught in violation of FERA act as he has taken bribe of Rs.70 lakh in foreign currency from most wanted terrorist Iqbal Mirchi and he was made to resign. The said news was published in all newspaper. The injustice caused to me was also published by various newspaper. Mid-Day paper cutting is herein annexed for Your Honor’s kind perusal. 5) Thus ,suffering since last 28 years ,it appears to me that some corrupt judicial officers have neither respect for law of land and violating the human rights of common people of our country which made my life miserable since last 28 years and I lost not only my all wealth but also suffered 3 times from tuberculosis, lost all teeth at very young age, I also suffered from hyper tension, hyper acidity, back ache , thyroid, vertigo, fractured foot, knee pain and many ailments while running from pillar to post by carrying 5 to 10 kg. Court papers every time which gives shoulder pain now and then. Now I am exhausted, the loan taken from friends, relatives,bank has been mountaining and it gives me feeling that corrupt judicial officers who have become heartless will never give me justice which compelled me to take decision of ending the life before the High Court,Bombay by peacefully protesting against injustice by fasting till death . . 6) I most respectfully request to donate my all useful organs to needy & poor people ,in case of my death during this protest by fasting. I further request to follow the cases even after my death , make a trust of my all wealth and use it for giving ROSHANI (Eye Sight) to poor patients so that I could continue the wish of my late mother which I have strated in the year 2003 and in the year 2004 by arranging and financing Free Eye Camp at villages, wherin thousands of poor people were benifited and operated for cataract. Unfortunately I could not continue said work further due to some corrupt judiciary who supported to multimillionaire accused without respecting to evidence on record of the court and misused the power to harass common people by giving tarikh pe tarikh and violated my human rights,snatched my livelihood, and denied justice to me . . I shall be gratefully obliged if I get justice during my life time with your Honors kind efforts. I herein specifically urge to Hon’ble CJI to take suo-motu cognisance of this matter & be pleased to direct the Hon’ble High Court ,Bombay to dispose off the above 3 matters (Cr.W.P.No.2037/2014,Cr.Revision 268/2014,Cr.Appeal No.1146/2013) on merits within 1 month.I shall be gratefully obliged for this act of kindness. ........
