SC rules on land powers September 26th, 2013 The Supreme Court (SC) has ruled that under the constitution, land powers cannot be in the hands of the provincial councils. In the ruling issued today the Court said that the right to land powers is in the hands of the central government and not the provincial councils. Lawyer Gomin Dayasiri told the Colombo Gazette that the three judge bench had determined in the ruling that under the 13th Amendment to the constitution the central government has the rights over land powers. In a longstanding case involving plantation land in Kandy, the Court of Appeal had determined that land powers are in the hands of the provincial councils. However Dayasiri said that the Supreme Court had today overruled that determination saying under the 13th Amendment to the constitution land powers are in the hands of the central government. Dayasiri, who appeared on behalf of the Ministry of Plantation Industries, said that the three Supreme Court judges were collective in their determination.
