SHARE: Obamas Illegal and Unconstitutional Executive Order. It is the privilege of CONGRESS to pass bills, to legislate, and more specifically under Article I, Section 8 of the U.S. Constitution, which reads in part, To establish a uniform rule of naturalization, and uniform laws on the subject of bankruptcies throughout the United States; As such, an executive order coming from the Executive branch that that makes a law, obliterate a law, or change a law is a violation of the aforementioned section of the U.S. Constitution. Johnson - 71 U.S. 475 (1866) It matters not if Congress does not act, or even does act, any type of immigration laws are the privilege of the legislative branch-CONGRESS. This goes further. As the President is obligated to enforce the law and obey the same under Article II, Section 3, which reads, ..he shall take care that the laws be faithfully executed.. Obama is in breach of his duty as President. Why? Because he is suppose execute the laws passed and signed into law. Obama with his executive order claiming Prosecutorial Discretion is a distortion of the same. Prosecutorial Discretion is in short selective enforcement not granting of work permits, visas, and who stays or who doesnt (but they can prioritize the prosecution, but they still get prosecuted). The granting of visas, work permits and who stays and who doesnt is creating law, not Prosecutorial Discretion and thus Obamas Executive Order is illegal (unconstitutional) and is a basis for his impeachment and removal.
