SPRISE! SPRISE! There has been a lot of talk about how President Obama’s healthcare law pushes people into either signing up for ObamaCare or paying a penalty to the IRS. Incidentally, the IRS fine is not generally well understood. Many people say the penalty is a flat $95 for the first year. It is actually $95 or 1 percent of your income, whichever is higher. Now a previously unknown rule has come to light that restricts the federal government from forcing you to take part in any type of government mandated healthcare. This rule also seems to restrict government from financially penalizing people who do not enroll in ObamaCare. “No individual, company, business, nonprofit entity, or health insurer offering group or individual health insurance coverage shall be required to participate in any Federal health insurance program created under this Act (or any amendments made by this Act), or in any Federal health insurance program expanded by this Act (or any such amendments), and there shall be no penalty or fine imposed upon any such issuer for choosing not to participate in such programs.” This seem to indicate that not only do people have the right to NOT enroll in ObamaCare, but may also have the legal means to back up their decision. President Obama will certainly not be happy with people finding out about this rule. An interesting exchange occurred at a recent town hall meeting between an attendee and DNC Chairwoman Debbie Wasserman Schultz. The person asked Schultz who gave them (the government) the authority to decide that he needed to buy healthcare. Her answer was revealing: “We actually have not required in this law that you carry health insurance. Let me explain what we did…we categorize you differently in terms of your tax return when your married versus single, just like we categorize you differently when you are a homeowner versus someone who doesn’t own a home…what we are doing is you will be in a different tax status if you carry insurance versus not carrying health insurance. So you can feel free to choose not to carry health insurance. That’s just going to be reflected in the tax category that you’re in on your tax return. But there is no requirement in this law that you must carry health insurance.” This is troubling because it is a convoluted and devious system. Sure, there is no technical legal requirement for obtaining coverage. But, those who do not will taxed. Sure, you’re not required to do anything. Feel free to choose your poison; either pay for incredibly expensive insurance or pay an incredibly expensive tax to the IRS …one that will increase each year. What do YOU think?
