Second hand goods on numerous sale pages could hold a few - TopicsExpress

Second hand goods on numerous sale pages could hold a few surprises to both those who sell or buy on these sites. From experience a particular point of order is sold with a gaurentee that in the end only the lucky few get honoured. The original suppliers provide goods to a customer, that person recieves legally a 12 warranty, and under the sale of goods act is expected to receive goods fit for purpose. That meansthey are expected to perform as a known device properly, and safetly, without causing harm or loss to the person supplied, if they fail to do so the supplier could be pursued legally. Selling second hand goods puts the same restraints on the seller, the only legal out is that they are sold as seen and reciepted accordingly. A proper description of the goods is compulsory in legal terms, failiure to do so mitigates towards those who purchased the said item or items. Few suppliers provide transferable guarentees, a second hand item being sold as such is often being mis-sold unless they provide a personal contractual gaurentee in written form. That makes the seller of such goods liable in legal terms , any faults or damages such equipment especailly electrical could come to large sums, but if buying such goods it protects the purchaser. So think before selling goods, describe them properly, apply them as ( sold as seen), or have a contract of sale and gaurentee drafted ready. Consider public liability insurance if you sell regularly, one day it could save your bacon. Purchasers remember you need independant proof , also evidence of being mislead before you pursue legal recourse. Then you need to find a brief that covers such work. Best advice is buy at the right price, after inspection as second hand goods, to learn this cost me money.
