Section 166 of the Penal Code Cap 87 of the Laws of Zambia read in part provides that; Any person who,having a husband or wife living,goes through a ceremony of marriage which is void by reason of its taking place during the life of such husband or wife,is guilty of a felony and is liable to imprisonment for five years... I have always been wondering why this section does not apply to customary law marriages when the law cleary provider that any person who,having a husband or wife.My contention is that the offence of bigamy applies to both civil and customary marriage and the police must proceed in that manner unlike the common practice which has been to target only those that contracted civil marriages!!!
