Section 26 Housing 26. (1) Everyone has the right to have access to adequate housing. (2) The state must take reasonable legislative and other measures, within its available resources, to achieve the progressive realisation of this right. (3) No one may be evicted from their home, or have their home demolished, without an order of court made after considering all the relevant circumstances. No legislation may permit arbitrary evictions. There is no internal limitation in the above section which prohibits the state from providing houses to people who were not directly affected or lived through the aprtheid era. It is common knowledge that a black child born today is going to be always disadvantaged as the result of the apartheid legacy as compared with a white child. I urge the hourable Minister to make an informed decision because this is spitting on the face of the youth. Unemployment rate stands at 58% among the youth in South Africa. They have clearly failed to create jobs and now they see that the statement Mandela made, that we going to build houses for you is not going to be realized, as long as the ANC led government is still in power. They have clearly lost touch with issues at ground level.
