Section 3A sub-section (3) of the Bangladesh Labour Act, 2006 [inserted by the Bangladesh Labour (amendment) Act, 2013 (Page 6458 of the Bangladesh Gazette, Additional, July 22, 2013)] is totally illegal. Law makers didn’t consider the basic principles of employment relationship. They also failed to consider the determination factors of employer-employee relationship. Besides this employment relationship is not a question of law, rather it’s a pure question of fact. The question in each case has to be answered having regard to the fact involved therein.
