Senator Ted Cruz (R-TX) poses a the question to constitutional scholar, Dr. John Eastman, as to whether or not the latitude of prosecutorial discretion can appropriately be stretched and applied in the manner which is currently being threatened by the Obama White House in the illegal amnesty executive action. He does not and cites a hypothetical comparison to a three year pollution permit, renewable indefinitely, being issued being as far removed from prosecutorial discretion as the current amnesty proposal.
