Shri A S Patel Labour Commissioner 11th,12th& 14th Block,2nd Floor, UdyogBhavan, Sector - 11, Gandhinagar 382010 Subject :Progress on FIR No. 308/013 registered at Vastrapur Police Station under Section 114, 409 & 418 of IPC against Directors of SaiInfoSystem (India) Ltd which has displaced 400 Employee families in Gujarat and additional 1000+ families Pan India by Management of SaiInfoSystem (India) Ltd, a Diamond Sponsor of Vibrant Gujarat Summit Request for an appointment with Hon CM with representatives of aggrieved employees SIS on 30th Sep / 1st Oct Respected Sir/s, This is in continuation to various communications to your offices dtd. 19th July 2013, 20th July 2013, 26th July 2013, 30th July 2013, 08th August 2013, 12th August 2013 & 12th September 2013. We are grateful to Shri Vijay Nehra from CMO NET for the help extended in registering the FIR against perpetrators after 2 months of efforts from aggrieved employees of SIS. However with change in his portfolio announced recently the employees were slightly concerned on progress of investigations. The regional media has done an excellent job to highlight the issues of the employees however despite news floating in local news papers like Gujarat Samachar, Sandesh, Times of India, DNA, Indian Express and Television channels like GSTV, IBN & Zee Business we haven’t seen the aggression from GoG to help the aggrieved families. We regret to inform you that despite the FIR having got registered on 4th September 2013, investigations being undertaken are not in line with what this case deserves. This is a pure case of Economic offence and financial irregularities undertaken by the Management of SIS and would get required justice only if investigated by EoW, CBI or SFIO (Serious Fraud Investigation Office). The local police despite their efforts may not be well equipped to investigate offences of this nature along with their daily chores. This case requires to be investigated by a dedicated team of specialists from the above mentioned agencies either managing it individually or under direct supervision of CMO office. We would like to inform you that perpetrators continue to defraud using various loopholes of Law as the local police may have their own limitations and understanding of processes to investigate Economic offenses and to stop them from doing so, hence the request. We feel that the documents and proofs handed over herewith are good enough for required agencies like CBI / SFIO and EoW to initiate enquiries against the culprits of this organization. A. Mr. Sunil Kakkad as CMD (Absconding since 27th June 2013) Notably he was not in Ahmedabad from 25th to 27th June hence no AGM may have taken place during this period for appointment of new Directors. B. Mr. PremBehl who claims to have resigned in May 2013 C. Mr. Samir Kakkad appearing as a Director on MCA website till 15th July 2013 suddenly vanishes. D. Mr. Mahesh Janthe (Housekeeping staff of SaiInfoSystem) gets registered on MCA website on 26th July 2013 E. Mr. ManishkumarKantilal Patel (Probably a domestic helper of Mr. Samir Kakkad now under arrest at Sabarmati jail.) gets registered on MCA website on 29th July 2013. F. If appointment date of Both Directors Mahesh Janthe and Manishkumar are 27th June 2013, then why were their names uploaded on different dates ? Incidentally 27th June is the day since when CMD-Sunil Kakkad has been missing. G. Mr. Prakash Mishra gets appointed on 8th August 2013. Which board members have approved appointment of Mr. Prakash Mishra if Sunil Kakkad has been missing since 27th June 2013, PremBehl claiming to have resigned in May 2013, SamirKakkad who was a Director also claims to have resigned on 26th June 2013. Has Mr. Mishra become the Director of SIS a 2000 Cr Organisation by board comprising of Housekeepers and Domestic helpers ? This is nothing but an eyewash and clear misuse of guidelines of Ministry of Corporate Affairs which though has been eased for business requirements and not crime. One needs to investigate the appointment of these Directors (Mr. Mahesh Janthe & Manish kumar Patel). If the Directors were appointed on 27th June 2013, what were the reasons behind the same being uploaded on MCA website on 26th July and 29th July instance? We have the screen shots of MCA website which is self-explanatory and shall be shared in subsequent mail due to mailing size limitations. As a process in any Public Limited Company were the banks communicated about the same about this change? There was no formal communication even to other shareholders or employees communicating the change. It is hence evident that the changes have been effected in the MCA website probably using either forged documents or presigned letter heads left by the CMD as part of his planned agenda. One needs to validate that who has uploaded these changes at MCA website and when with the help of Cyber-crime Specialists. They would be able to identify the same thru IP address which would have got registered at the site while uploading the same. Notably the HO of SIS has also been from shifted from Saicare, Superplaza, Sandesh Press Road, Vastrapur to 1st Floor,Paresh Apartment, Nr. Chaitanya Bus Stop, Stadium Petro Pump, Navrangpura, Ahmedabad. (Attaching two letters one written by Director and other by an employee to Rajasthan State Road Transport Corporation) which clearly showcases the organization being operational. Basic Questions which remain unanswered 1) If the board has been reconstructed then, has there been any communication to RoC / Employees about the same ? 2) What is the reason behind not displaying any board at the registered office communicating Change of address of HO from Vastrapur to Navrangpura ? 3) Who has leased the office of SIS to ETCO Digital and why ? 4) Why only handful of employees are being allowed to enter office and not the entire lot ? 5) What plans does the newly constructed board have towards payment of Salaries and dues to the aggrieved employees of SIS ? 6) Where are the funds coming for keeping the SIS office operational from Navrangpura ? 7) Who are the current employees of SIS operating from Navrangpura office ? 8) Investigate connections between operations of ETCO Digital and SIS This is a deliberate disguise of having leased the office of SIS to ETCO Digital. This organization is none other than one of the lenders to SIS. The parent organization ETCO Industries had extended a loan of 15 Crs out of which 8-9 Crs were returned thru LC of Canara Bank. (Copy attached). One of the SIS office located 1&2 Paresh Apartment, Nr. Chaitanya Bus Stop, Stadium Petro Pump, Navrangpura, Ahmedabad gets leased to a new organization. Mr. Rajeev Gupta (Sr. VP-Telecom) and a Director in one of the group companies of SIS (Atrium Infocomm) gets hired by this organization named ETCO Digital. On telephonic interrogation by Police he confirmed that the office was given on rent by the new directors of SIS. Mr. Prakash Mishra (Addl Director) had been called for discussions at Vastrapur Police Station but status unknown thereof. Rajeev Gupta has further hired few employees of SIS who were extremely close to Sunil Kakkad or were managing some critical roles like collections, data center management etc. The intent of this organization is to collect the outstanding from market and claim to have been supported by SBI officials at Ahmedabad. As per possible agreement between ETCO Digital and SBI, all outstanding payments that gets collected would be shared in proportion between the two organisations. Opening of a separate account has also been approved by Bankers as other accounts of SIS are attached by Income tax and other Government agencies. Customers confirm having received calls from ex-employees of SIS for payments stating that ETCO Digital has taken over SIS and are requesting them to issue the outstanding payment due to SIS. One such customer is Police Head Quarters Bhopal which can be called upon and validated with. One of the Ex-employee Anupam Desai who was responsible for operations in SIS has taken over in the same capacity in ETCO Digital. He was in Bhopal on Friday 6th September 2013 to collect payment from Bhopal PHQ. The officers PHQ Bhopal have requested them to share the takeover documents etc and the committee would take a decision post that. Since that day no document whatsoever has been shared with the customer as per the last available information. PHQ / SCRB officials can be called upon to validate the same on +919977446333. (Disclaimer** : This information of ETCO’s operations has been shared by an employee of ETCO Digital on commitment of anonymity) We therefore request you to look into the matter and ascertain the possible involvement of Bank officials and current / old Directors of the organization. We would also request you to check with the 6 defrauded banks on the investigation and enquiries initiated against the fraudulent loss incurred due to possible irresponsible behavior and conduct of their employees. It is indeed unfortunate that despite having handed all the necessary proofs to Police there are no investigations happening on the captioned matters. If this is the plight of educated citizens who have been knocking doors of Government agencies, struggling to gain attention, I sincerely imagine what would be the plight of a common man living in villages of the country wanting to register complaints with limited access to the Bureaucrats thru eGovernance initiatives. Sir/s : NAMO Government was known for its able administration but instances like these are raising questions on our thoughts? 1400 families and other joining the fight of aggrieved employees thru Facebook (https://facebook/SisEmployee) are waiting for you to act !!! Is this what citizens should expect from a candidate who is gunning to be the next PM of the Country? Immediate help requested 1) Investigate the operations of ETCO Digital undertaken under the mask of SIS and stop them from interacting with SIS customers for collection of payments at the earliest. (The money collected would be taken away by the perpetrators and banks instead of paying dues to the 1400 aggrieved employees and statutory dues to Government. 2) Investigation to be handed over to SFIO / CBI / EOW as against being undertaken by local Police purely on technical grounds and on account of the nature of the case. No offence intended towards Local Police who have for sure been extremely supportive post FIR getting registered. 3) Thorough investigation of SIS officials from Finance Department especially those who have been named in the complaint submitted to Vastrapur police Station. The CFO of the organization along with his team from Finance Department and Directors of other group companies were totally aware of the health of the organization and abetted CMD in this heinous crime. 4) Sealing all warehouses across the country before the goods are siphoned and sold. 5) Probable help from Government of Gujarat by forwarding our case to the judiciary ie High Court, Sessions Court etc to avoid granting Anticipatory bail to other perpetrators who have applied for Anticipatory bail and have an hearing on 1st October 2013. 6) Oblige a meeting to Employees of SIS for a brief discussion purely as per your convenience and availability on Monday 30th September 2013 or Tuesday 1st October. · The meeting request mentioned herewith is for Shri Narendra Modi only and not any of the MPs or junior officers as this is a case of 1400 aggrieved families and may get best attention under guidance and supervision of the Hon.
