Seriously - WTH? I can see where the Ward family could sue Tony for wrongful death, but this was a ON TRACK ACCIDENT. The kid shouldnt have walked out onto the track to begin with! Common sense! Ive listened to numerous news stories since yesterday (hell, Glenn Beck started his show with it this morning) and the ongoing consensus seems to be that it wasnt on purpose. Yes Tony is a hot head, thats well established. Could he have wanted to scare the kid by swerving toward him? Possibly. He didnt KILL him intentionally. The media has already condemned Stewart and labeled him more or less as a murderer. Tragic as it is, the bottom line IMO is that Ward should have stayed off the damn track until emergency vehicles got there and then took it up with Stewart in the pits.
