Sheikh al Mufid(ra) on Wilayatul Faqih. And as for the implementing of the Hudud (Islamic penal codes) then it is for the ruler (sultan) of Islam, those appointed by Allah(swt) and they are the guided Imams from Aal e Muhammad (saws) and those whom they they have appointed from the commanders and rulers and according to this appointment they are the fuqaha from among the Shia where it is possible. (Here the Sheikh then says its necessity is only dropped where the fuqaha cannot excersise their authority due to a tyrranical ruler). (Likewise if he is able to establish the hudud over his people or due to being delegated to it by the oppressors then he is to cut off (the hands of) the thief, lash the fornicator and kill the murderer. And this is an obligation on those who are incharge to implement the hudud, enforce the judgements, enjoin the good and forbid the evil and jihad against the Kuffar and to punish accordingly those from the immoral people.)
