Since the Kenyan cases were not reffered to ICC by the Security council ..ICC pre/trial chamber was very careful in its initial stages on whether the Kenyan cases fell under its Jurisdiscation ..ICC prosecutor had a heavy task to convince the judges to be allowed to commence investigations in the Republic of Kenya ..thus .......Thus, the Chamber considers that for a crime to fall within the jurisdiction of the Court, it has to satisfy the following conditions: (i) it must fall within the category of crimes referred to in article 5 and defined in articles 6, 7, and 8 of the Statute^^ (jurisdiction ratione materiae); (ii) it must fulfill the temporal requirements specified under article 11 of the Statute (jurisdiction ratione temporis); and (iii) it must meet one of the two alternative requirements embodied in article 12 of the Statute (jurisdiction ratione loci or ratione personae)."^"^
