Subject: Illegal Unauthorised Development on Land South of Durleigh Road Planning Applications 08/12/00143, 08/12/00182, 23/12/00004, 08/14/00044 Dear Gill, Ann and David Illegal Unauthorised Development on Land South of Durleigh Road Planning Applications 08/12/00143, 08/12/00182, 23/12/00004, 08/14/00044 We are now approaching the final stages in resolving the Illegal aspects of the above planning approvals. These approvals are in direct non-compliance with the Planning Inspectors SDC Core Strategy Examination Report. During this marathon exercise, we have encountered many SDC created barriers and numerous unnecessary obstructions. We have established that the SDC Monitoring Officer, who is responsible for advising the Development Committee on legal matters, continues to be unable to provide evidence or demonstrate that land south of Durleigh Road has been justified and sanctioned for development. Without this evidence, SDC has no authority to approve development on this land. This is a serious developing problem with enormous implications, the consequences of which are escalating daily. It is notable that the Planning Inspectorate has chosen not to support SDC. Mr Pritchards letter dated 21 July 2014, which was forwarded to us by the SDC Chief Executive, does not provide the information that the SDC Monitoring Officer was seeking. Importantly, Mr Pritchard has avoided confirming that development on land south of Durleigh Road is legal. Likewise, the Planning Inspectorate has not confirmed that the Planning Inspector Mr Sims has justified or sanctioned development on this land. No evidence can be found anywhere in the report to confirm that the Inspector has justified or sanctioned development on this land, as is required by his procedures. You cannot continue to ignore the fact that the Core Strategy has been pronounced sound by the Inspector, without the inclusion of land south of Durleigh Road. Furthermore, the inclusion of this broad location in the SDC Adopted Core Strategy at paragraph 6.9 is illegal. We have written to you all personally on many occasions, but you do not respond and it has been necessary to take more extreme action. We feel that it is courteous to inform you, as our Ward representatives, that we have requested the Secretary of State for Communities and Local Government to formally investigate the actions and omissions of SDC and SDCs failure to comply with the Government Inspectors Report. By failing to understand the Inspectors SDC Core Strategy Examination Report and the rules that govern its production, you have allowed the SDC Development Committee to illegally approve planning applications on land south of Durleigh Road. The combination of failing to understand and failure to comply with the Inspectors Report together with the dismissal of vital evidence provided by us, who do understand the Inspectors Report, has led to this badly confused and ridiculous situation. Again, during the process, because SDC have been unable to demonstrate or answer our questions on legality and have failed to comply with the Inspectors Report you have allowed SDC to accuse us of being vexatious and disruptive to staff. Throughout this extensive exercise, you have made no attempts to defend us, or support us as our representatives, from these unjustified accusations.
