So the Supreme Court has stated that police now cannot search your phone without a warrant. This is because they are now deeming a cellphone as a small computer, and thus, contains lots of private information such as bank account records, credit card info, and other such stuff that is protected by law. In the past police treated your phone as if they found a box of stuff in the backseat of your car..and could just go through it freely, finding info that could incriminate you in other crimes, or use it to track you, know where you live, and who you talk to. Now if you get stopped, they cannot go through your phone at all, the same as they cannot enter your house and go through your computer without a warrant. This of course is great for privacy advocates, and anyone who believes police often over step their boundaries. Personally I think this is a huge win for the American public, and although some criminals will get let go due to a technicality, it also sets clear rules on what police can and cannot do when they stop you. Now comes the question..can they take it without a warrant, and hold it until they get one? I think in most instances, you can simply announce a warrant is needed, and they have to give it back. This also sets a precedence as to if they can use info obtained from the cloud.
