So update on ARMS... They called a meeting after court, and I have just met with their lawyer and a company representative along with my Lawyer. They have seen the server room (and have photographic evidence.) They have a copy of my original request to be switched to commercial (and have acknowledged that the forms would not have been accepted because I havent got a VAT or Company number, but have accepted I certainly look like a company.) They denied the law states that they have to apply the banding per-annum commenting that the law allows pro-rater billing.... Which I pointed out the law states per-annum on the charging/banding and that they may bill on a pro-rater basis.. not that they can apply the banding on a pro-rater basis, only that they may charge on that way. The lawyer assured me they are charging correctly, I respectfully suggested he re-read the legislation and check his understanding as I was happy to go to court over it if necessary. We didnt get very far really - arguing the same and unrelated points over and over again... However, he knows that I believe in my rights and believe that the courts will rule in my favour, and that I am willing to take it that far if necessary... so consequently hes taking it to the board... not guaranteeing a positive result, but will take it to the board. (to quote him)... We will have to wait and see... I suspect he knows about the banding/pro-ratering issues, and they dont want to admit it (especially in court) as it would cost them millions in Euros for every person/house/company in Malta in over charge refunds and re-working of every bill...
