Some good news! The Federal Court granted Safe Parks request for a preliminary injunction against the City of Tucson. Specifically, the injunction enjoins the city from harassing homeless people occupying a portion of a public sidewalk. Previously such homeless people were arrested, and their personal property was confiscated and/or destroyed. The injection prohibits the city from enforcing the 3-B policy, which said that the only personal property a homeless person was allowed was a blanket, a bedroll, and a beverage. The court also ruled that the homeless people were, in fact, expressing their First Amendment rights to inform the general public of their political message (in this case, the plight of the homeless). As such, they have a legal right to be present on the sidewalk, with whatever personal property they happen to have. This is quite a blow to the city, and it doesnt bode well for their chances when the lawsuit for damages is eventually heard.
