Something in my mailbox for you Californians, especially those in Siskiyou County. Lets remember that it was the Karuks who instigated the dredge ban in California. These need to be to your elected officials by Tuesday. VOTE NO TO S.B. 1224 – THE KARUK CASINO RATIFICATION! Office of Assemblyman (Insert District and Address) Office of Senator (Insert District and Address) Re: TITLE: An act to add Section 12012.62 to the Government Code, relating to tribal gaming, and declaring the urgency thereof, to take effect immediately. S.B. No. 1224-Correa. May this correspondence serve as my expression of opposition to the Karuk Tribe to design, build and operate a Casino on Karuk Tribal lands within the City of Yreka California. Background for justification of opposition to S.B. 1224: The Karuk Tribe committed presumptive fraud and has duped the State of California by claiming “federal recognition” using Treaty R stolen from the Shasta Nation. Treaty Q belongs to the Yrok tribe of which the Karuks are a known subset. At no time have the Karuks signed any treaty with the United States Government. They used stolen documents to wrongfully gain Federal Recognition in 1979. This clouds the “Federal Recognition” status of the Karuks. Until this question has been resolved with certainty, the State of California risks becoming a party to perpetuating this fraud by ratifying S.B. 1224. The lands targeted for the Yreka Casino are designated for housing. No proof of Federal application for “Amendment of Housing Trusteeship to Casino Trusteeship” was filed with the Department of the Interior for judicial review for approval as required by Federal Law 25 U.S. Code § 2714 - Judicial review. The Indian Gaming Regulatory Act (“IGRA”) specifically prohibits gaming on lands acquired by the Secretary of the Interior in trusteeship for the benefit of an Indian tribe after October 17, 1988. This applies to the Yreka Housing Trusteeship lands. The “justification” cited as IGRA 1(b)iii, restoration of lands”, is also required by Federal Law 25 U.S. Code § 2714 to undergo Judicial Review and approval before any land use conversion is allowed. Investigation has proven these Yreka fee simple lands were never aboriginal to the Karuks and thus to assert “restoration” without Federally required Judicial Review is a complete falsehood and perfidy by the Karuks and the bill sponsor, Senator Correa. The documents that have been submitted are merely opinions by the National Indian Gaming Commission (NIGC) on Indian lands pursuant to the Indian Gaming Regulatory Act (IGRA), 25 U.S.C. $2719. This clouds the title to the Yreka Trusteeship housing HUD funded lands for the Karuk. They have not proven nor provided a clear chain of title, with judicial review approval, showing any change of Trusteeship assignment from housing designation to a Trusteeship casino business enterprise. The NIGC does not have authority to make this change. This needs clarification with certainty! Additionally, the negotiating Karuk Tribal leader, Vice Chairman, Leaf Hillman, is a violent convicted felon and has falsely represented the Shasta Treaty R to the U.S. Government in Congressional hearings to attain federal recognition and access to Bureau of Indian Affairs (BIA) funding. This created a fraudulent presumption to the State of California that a legitimate Federal recognition exists of the Karuk tribe. Governor Brown was duped in this anecdotal conjecture by known felon. Thus Governor Brown unknowingly signed the Karuk Casino Compact agreement under false presumption. By extension, this puts the State of California in a tenuous position of sanctioning a criminal enterprise if S.B. 1224 is ratified. Judicial review needs clarification with certainty before proceeding further with S.B. 1224. This Casino will be a detriment to our Yreka community and further destroy our social fabric. There are conflicting opinion of fact and law that needs judicial review. In light of these conflicts the bill should not be amended. Please DO NOT RATIFY OR AMEND this Karuk Casino Compact that will jeopardize our community! Thank you.
