Standard of proof at the ultimate Court of Hereafter In civil cases, the Claimants need to prove their case in the court against the Respondents. The onus of proof is on the Claimants. In order to win their case the Claimants have to prove their cases on the balance of probability. On the other hand, the onus of proof in the criminal cases lies on the Prosecution. The Prosecution needs to prove the cases against the accused/defendant beyond reasonable doubt. So, the standard of proof in the civil cases is the balance of probability whereas the standard of proof in the criminal cases is the beyond reasonable doubt. In the world’s court, no matter where and which country it is, we often see the Claimants in the civil cases lose their genuine cases simply because they could not prove their cases on the required standard or often the Claimants win their weak or false cases simply because they were able to prove their cases on the balance of probability. Similarly, we see a lot of criminals are acquitted simply because the Prosecution could not prove the cases on the required standard or many innocent people are convicted and punished simply because the evidence of the Prosecution, despite being tempered or false or concocted, was well believed by the concerned Judges and/or Jurors. However, in the Hereafter, the situation and circumstances would be completely different. The Judge of the ultimate court would be the Lord of the Universe. The world’s judicially and legally invented standard of proof would not be applicable there. The standard of proof at the ultimate Court of the Hereafter would be the wholly truth, nothing but only the truth. Justice there would be proper and accurate in literal and true sense, 100% - nothing less and nothing more!
