Medical Universities have significant role in expanding medical education and extension of clinical research; so that curative services should be at their highest level. When, these universities build upon the existing well established health institute that means snatching of basic medical services of poor and marginalized people of the nation and damaging the civil rights of the employees of the Pakistan Institute of Medical Sciences which is now changed into Shaheed Zulfiqar Ali Bhutto Medical University under your kind approval Act of SZABMU, 21st March 2013. It is consensually be requested that the present status quo of Pakistan Institute of Medical Sciences should be restore under the administration of Federal Government (CA&DD Ministry) and SZABMU should be worked independently under the administration of Chancellor and Vice – Chancellor as like LUMHS Jamshoro, DUHS Karachi, Shaheed Mohtarma Benazir Bhutto Medical University, Larkana, Peoples University of Medical & Health Sciences, Benazirabad (Nawabshah) and UHS Lahore and all attached hospitals with mentioned Medical and Health Sciences Universities are running under provincial Government. Always, Medical Colleges / Institutes are upgraded into Medical and Health Sciences Universities, not the Hospital (Service) side. All the Provinces (Punjab, Sind, Baluchistan, Khyber Pakhtoon Khawa etc.) will lose their allocated quota seats through FPSC in PIMS, Islamabad. “PIMS” Hospital is already attached hospital with Federal Medical and Dental College, Islamabad. Your Excellency Sir, With profound respect, we are very glad that Shaheed Zulfiquar Ali Bhutto Medical University Islamabad has been founded in beautiful capital city Islamabad. No doubt, Medical Universities have significant role in expanding medical education and extension of clinical research; so that curative services should be at their highest level. But Sir, when these universities build upon the existing well established health institute that means snatching of basic medical services of poor and marginalized people of the nation and damaging the civil rights of the employees of the organization. Likewise, Pakistan Institute of Medical Sciences reformed into SZABMU. Sir, your esteemed Act of Shaheed Zulfiquar Ali Bhutto Medical University Islamabad, March 21st, 2013; in view of abolishing present status of PIMS as other public medical universities have quite different status from universities to the hospital services and administration. Because universities are working under Chancellor Control i.e. LUMHS Jamshoro, DUHS Karachi, Shaheed Mohtarma Benazir Bhutto Medical University, Larkana, Peoples University of Medical & Health Sciences, Benazirabad (Nawabshah), Kyber Medical Univerity, Peshawer and UHS Lahore; and attached hospitals are working under Provincial Government. Always, Medical Colleges / Institutes are upgraded into Medical and Health Sciences Universities, not the Hospital (Service) side. (Copies of Universities Act are attached herewith). The main reservations regarding the SZAMU Act 2013 in relation to PIMS hospital status are as under: 1. Point (i) under Definition, “Hospital” means a hospital maintained and administered by the University. 2. Chapter No: II, section no. (03), under incorporation “The University shall be autonomous, body corporate by the name of Shaheed Zulfiqar Ali Bhutto Medical University, Islamabad. 3. Chapter No: II, section no. (03) sub – section no. (06), under incorporation, the post / office of the Executive Director, Pakistan Institute of Medical Sciences, Islamabad shall be upgraded to that of the Vice Chancellor and shall be 1st Vice Chancellor. 4. Chapter No. III, section no. (19), sub – section no. (03), under other officers and staff members, any question arising under the proviso to the sub-section (02) shall be referred to the Federal Government and decision of the Federal Government on such question shall be final. Until the rules regulating the services of the employees of the university are made, all service rules as are applicable to employees under the Civil Servant Act 1973 (LXX1 of 1973) shall apply to the employees of the University in so far as they are not inconsistent with the provisions of this act. (Copy of university bill is attached herewith) Justifications in reference of Liaquate University of Medical and Health Sciences (LUMHS), Jamshoro, Dow University of Health Sciences (DUHS) Karachi and University of Health Sciences (UHS) Lahore. 1. & 2. Point (i) definition of “Hospital” in SZAMU Act 2013, which is not mentioned in above cited universities Act / Ordinance but those universities were established in the up-gradation of medical colleges and separate entity of university. This means those cited universities act/ordinance did not abolish or change the present status or ex – officio of Hospital administration. Discussion: In SZABMU Act 2013, the Executive Director Post / Ex – officio is upgraded / changed into Vice – Chancellor, whereas in above cited Universities Act / Ordinance, they did not change Medical Superintendent / Medical Director into Vice – Chancellor and present status of the hospital remained the same. Impression: PIMS Hospital status is totally changed into SZABMU status. But “hospital” is the institute, provides preventive, curative and rehabilitative health services to the patients under Federal / Provincial Government, which is attached hospital with university for clinical / teaching purpose. Conclusion: This means employees of the hospital will be part and parcel of university, under the administration of Vice – Chancellor. This definition “Hospital” is knowingly included in this section whereas other universities have defined this as “Constituent College”; in terms of upgrdation of Medical College into medical university or university in a separate entity. 3. Chapter No: II, section no. (03), under incorporation “The University shall be autonomous, body corporate by the name of Shaheed Zulfiqar Ali Bhutto Medical University, Islamabad. Discussion and impression: No doubt, universities are autonomous under the instruction of Higher Education Commission and purely constituted under the promulgation of worthy the Chancellor (President of Pakistan in Federal Government and Governor in Provincial Government). Conclusion: This means, the present status of PIMS hospital will convert into autonomous, and body corporate like SZABMU Hospital Islamabad. In consequence, the university will generate its revenue by increasing the cost of health care services. According to Human Development Index 2009, 60.3% of Pakistans population lives on under 2$ a day (equivalent 6000 PKR per month) and Economic Survey of Pakistan (2010 – 11) estimated that 43% of population live on under 1$ a day (equivalent 3000 PKR per month) below poverty line. If making organization / hospitals autonomous, these means snatching of basic health care facilities from poor and marginalized people / patients of Photohar region, interior Punjab, Gilgat Bulchistan, Azad Kashmir, Khyber Pakhtoonkhawa, Hazara Division, peripheral areas of Rawalpindi and Islamabad. 4. Chapter No. III, section no. (19) Sub – section no. (03), under other officers and staff members. Discussion and impression: In view of above cited universities impression, in which they work under the Chancellor (President in Federal Government and Governor in Provincial Government) and attached hospitals are working under provincial secretary of health department. Their employees are working under the Civil Servant Act. 1973. Conclusion: It is highlighted, if above cited universities and attached hospitals are working under different administrative hierarchy (Chancellor and Vice – Chancellor for Universities and Medical Superintendent / Medical Director / Executive Director for hospitals). Why PIMS Hospital should not be worked under Federal Government (Ministry of CA&DD) and SZABMU work under separate entity without abolishing / damaging status quo of the employees under Civil Servant Act 1973. By implementing the Act of University on separate entity, PIMS hospital will work more effectively and efficiently so that quality services may be ensured by protecting employee’s civil rights. Shaheed Zulfiqar Ali Bhutto is considered the main architect of 1973 constitution as part of his vision to put Pakistan to road to parliamentary democracy. One of the major achievement in Bhuttos life was drafting of Pakistans first ever consensus constitution to the country. This legal document emphasizes to preserve the Civil Servant rights and protect the consumer rights for accessing basic need of health care facilities on affordable cost. In this scenario, one side the University is established on the name of Shaheed Zulfiqar Bhutto Ali Medical University the pioneer of Constitution 1973, and on other side the Civil Servant rights are violating under the shadow of his prestigious name by abolishing and damaging the present status quo of Pakistan Institute of Medical Sciences, Islamabad. Therefore Sir, it is dire need of justices to review the present Act 2013 of SZABMU and make necessary amendment in light of above cited universities Act / Ordinance. Your Excellency Sir, the employees of PIMS hospital and people of all walks of life are looking for your fair decision for restoring present status quo of PIMS under Civil Servant rights. In this approach, both promises of Shaheed Zulfiqar Ali Bhutto may optimally be fulfilled in the view of constitutional amendment in University Act, in favour of poor patients and protecting the Civil Servant Rights of employees.
