Summit County Prosecutor Sherri Bevan Walsh announced that late yesterday a jury found Brett Phelps, 36, of Frisby Avenue in Barberton, guilty of Assault on a Police Officer, a felony of the fourth degree, and Domestic Violence, a misdemeanor of the first degree. On New Year’s Eve, Akron police officers were called to the intersection of SR 59 and N. Howard Street because a woman was trying to flag down cars there. Phelps, his father and his girlfriend were at the scene. Phelps’ father and girlfriend told officers that they were driving down the road when Phelps, who was drunk, started to get angry and punched his father. As officers tried to put Phelps into a cruiser, Phelps bit one of the officers on the thumb. Judge Christine Croce will sentence Phelps June 10 at 1:30 p.m.
