Suppose youre a soybean farmer. You farm your own land, use your own equipment, and you dont buy seeds from Monsanto. However, the farmer down the road does, and through cross pollination, your crops carry Monsanto-patented genes. They find out and sue. Now the burden of proof is on you to prove your innocence. The team of lawyers you hire cannot compete with their lawyers, you run out of money, and end up with a settlement where you pay a huge fine that you dont deserve. Now, lets suppose that instead, you and your farmer buddies form a corporation with no assets of its own. You each lease your land and equipment to this corporation. You are also employed by this corporation that you and your buddies own to operate your equipment on your land. When Monsanto sues you, the corporation hires some lawyer right out of law school for next to nothing. Win or loose, the corporation doesnt settle. If you loose and the corporation goes into bankruptcy, your personally owned assets are protected. You and your farmer buddies simply dissolve the corporation and form a new one. The process actually costs Monsanto more than it costs you and your partners. Im sure it cant quite be as simple as that, but their must be some sort of way like this to deal with assholes like Monsanto.
