Supreme Court Judgement quashing common medical entrance retrograde-Government must seek review and come out with a law It is unfortunate that the Supreme Court has quashed the common National Eligibility cum Entrance Exam (NEET) conducted by the Medical Council of India for undergraduate and post graduate medical seats in Government as well as private medical colleges. The Court has held that the medical council has no authority to force Private medical colleges to admit students on the basis of NEET, since this is beyond the MCIs power of regulating standards of Medical Education. This judgement has been delivered by the outgoing Chief Justice Altamas Kabir, hours before his retirement. It is significant that Justice Dave has strongly disagreed with this judgement pointing out that it is not only permissible for MCI to regulate the entry of Students in Medical courses through a proper entrance exam, it is also desirable to do so for preventing medical colleges from offering seats to undeserving students on the basis of bribes and capitation fees; and also to spare the students the agony of appearing in hundreds of separate exams. In fact, the common entrance exam had been brought in by the MCI at the instance of the Supreme Court itself in 2010.
