Supreme Court upholds Kaka’s election: From SEGUN OLATUNJI, Abeokuta The Supreme Court has confirmed the election of the senator representing Ogun East Senatorial District in the National Assembly, Alhaji Gbenga Kaka. In a unanimous decision, the Supreme Court dismissed the appeal filed by Chief Adebisi Adegbuyi against Kaka’s election as a senator for lacking merit. The apex court also awarded N200,000 as costs against the appellant. The All Progressives Congress (APC), substituted for the defunct Action Congress of Nigeria (ACN); Kaka and the Independent National Electoral Commission (INEC) were the respondents in the suit. The appellant, who was an aspirant for the Ogun East Senatorial ticket in the 2011 polls, had challenged Kaka’s election into the Senate. He had claimed that the defunct ACN did not conduct a primary election in the senatorial district in accordance with Section 87 of the Electoral Act 2010 (as amended). Adegbuyi had prayed the court to set aside Kaka’s nomination by the party and to direct the defendant to accept him as the senatorial candidate. He had also sought an order of perpetual injunction restraining INEC from recognising Kaka as the senatorial candidate in the April 2, 2011 election. On April 1, 2011 and May 24, 2012, the Federal High Court, Abeokuta and the Court of Appeal, Ibadan Division dismissed the appellant’s case respectively. But in a unanimous judgment delivered on December 19, 2014, five justices of the Supreme Court held that the appellant’s case lacked merit. Justices John Afolabi Fabiyi, Bode Rhodes-Vivour, Musa Dattijo Muhammad, Clara Bata Ogunbiyi and Kumai Bayang Aka’ahs dismissed the suit. In the lead judgment by Justice Fabiyi, a copy of which was obtained by our correspondent yesterday in Abeokuta, the Supreme Court upheld the verdict of the appellate court that the appellant formally withdrew from the senatorial primary election and therefore lacked the locus standi to institute a legal action. Court remands man in custody over murder An Ota Magistrates’ Court in Ogun State yesterday remanded a 38-year-old man, Muyideen Olasunkanmi, in prison custody over alleged murder. Olasunkanmi was arraigned for allegedly killing one Ramon Yusuf, 29, by shooting him with a gun. The Chief Magistrate, Mrs Titi Bello, said the accused should be remanded in prison pending advice from the state Director of Public Prosecutions (DPP) on the murder charge. Earlier, the prosecutor, Inspector Peter Molokwu, had told the court that the accused and others still at large, committed the offence on February 15, 2012 at Itele in Ado-Odo Ota Local Government Area of Ogun State.
