Suresh Khaitan writes: Most of the litigants from Lower/middle income group cant afford the litigation filed against them in the courts. It has been reported in Times of India today dated 24.11.14 that Muslims, Dalits and Tribals form 53% of jail population because they couldnt afford to fight in courts. It is not true. Not only Muslims, Dalits and Tribals but every common man in the low/middle income group who failed to afford fighting in courts, are in jails. System does not target a particular caste, but it targets evey such common man who cant afford financialy the fighting of the ltigation. If a survey be conducted from this angle, we will find that 95% ( if not more) of such prisoners are in jail who couldnt afford fighting the litigation moneywise. Rich Muslims, rich Dalits ( like Mayawati) and rich tribals too defend their cases because they have money. IT IS THE MONEY ONLY THAT MATTERS. Most common men or litigants in lower income group who Just manage their expenses, can not afford litigation and accept the jail or illogical/unfair award or judgment as their destiny. Even for the upper middle class families, it is not possible to financialy/mentally afford the litigation that prolongs for decades. The money they have to spend on advocates fees, the stress and mental agony that they have to face all through the period ( that too without any guarentee that they will get justice in lower/High/Supreme Court), humiliation that they have to undergo in the hands of advocates who treat them with inferiority are the factors that make compell them to be blackmailed and submit to the conspiracy of the opponents in false cases. Interestingly, courts also allow such compromises where litigants plainly submit that in order to avoid harrassment and to buy mental peace and without admitting liability, they are making payments under the compromise. It is a MATTER OF SHAME FOR WE ALL AND FOR OUR ALL THE FOUR ORGANS OF DEMOCRACY I.E. JUDICIARY, LEGISLATURE, EXECUTIVE AND PRESS.
