TCS revokes termination of woman employee A week after a pregnant woman employee of Tata Consultancy Services (TCS) moved the Madras high court and got an order terminating her from service stayed, the IT major revoked the ouster order on Tuesday. Now that Rekha (name changed) will not cease to be a TCS employee on January 21, 2015, the court closed the case on Tuesday. Amid reports of en masse termination of employees by TCS, Rekha moved the high court describing her ouster as unfair. Noting that she was a workman as defined under the Industrial Disputes Act, 1947 and that the company could not terminate her services without following mandatory procedures laid down in the Act, she wanted her removal from job stayed. She said she was issued a termination order on December 22, 2014 and she was to be relieved from duty by January 21, 2015. On January 13, Justice R Subbiah granted an interim injunction restraining TCS from giving effect to the termination order for a period of four weeks. Though the matter was scheduled to come up for hearing only next month, companys senior counsel Yashod Vardhan mentioned the matter before the judge on Tuesday and informed the court that the company had revoked the termination order issued to Rekha. Taking the revocation order dated January 20 on record, the judge said the matter has become infructuous as there remained nothing to adjudicate now. Since TCS has revoked the letter dated December 22, 2014, which is the subject matter of the petition, I do not find any reason to keep the petition pending further, the judge said.
