TDS is seeking a Capital Trial Project Attorney. The application deadline is Friday. Texas Defender Service (TDS) seeks an attorney with capital defense experience at the trial or habeas levels and a demonstrated commitment to indigent defense to serve as a staff attorney in TDS’s successful Capital Trial Project team. TDS is a private, non-profit organization whose mission is to improve the Texas criminal justice system by reducing unfair use of the death penalty and by implementing an effective indigent defense system. The Capital Trial Project tracks all death-eligible cases in Texas, monitors appointment of counsel, and trains, consults with and provides resources for attorneys representing death-eligible defendants. The Capital Trial Project’s overall goal is to decrease death sentences and improve the quality of trial-level capital defense in Texas. The Capital Trial Project attorney works as a resource lawyer. She or he will train, consult with, and assist capital defense teams throughout Texas, and monitor capital cases in Texas. Training duties will include planning and presenting at continuing education programs for Texas criminal bar members and their capital defense team members. Consultation duties will include, but are not limited to, preparing and distributing briefs and motions, helping teams to work in a team oriented manner, assisting teams in determining appropriate experts and making expert referrals, working with teams in developing themes for life that are consistent with their guilt/innocence themes, helping teams develop mitigation evidence and effective presentation methods, and working with the teams to achieve death penalty waivers and life-saving pleas. Additional duties will include monitoring and collecting data on all Texas capital murder charges and trials. The ideal candidate for this position: is a self-starter; possesses leadership skills; has handled death penalty cases at the trial level; has excellent legal research and writing skills; is skilled in oral advocacy; can work in a team-based environment; is highly organized; and works effectively under pressure. The ideal candidate will also be knowledgeable about the latest developments in criminal law and have experience training other attorneys. Given the nature of the work, the successful candidate should expect to work some evenings, weekends and holidays. Travel throughout Texas is required. All applicants must be eligible for licensure to practice law in Texas. Fluency in Spanish is a plus. This is a full-time position and the attorney hired may choose to live in Austin or Houston. Salary will be based on experience.
