TELANGANA-EK PARICHAY 1. How a new state is formed 1. The President asks the concerned state/s to pass a resolution to this effect within a timeframe. 2. Having got the resolution passed, the Cabinet meets along with the PC deputy chairman (Q4U- Does this person participate in all cabinet meetings?), a Commission is formed to decide the boundaries, distribution of finances, centres of administration etc. However the resolution need not be accepted as such by the central legislature and the formation of the commission is not mandatory either. 3. A draft Bill is formed which is then recommended by the President to the concerned State Assembly for its view, consideration and ratification within a timeframe which the President decides . Amendment 5 makes doing it mandatory, however again the decision of the State Assembly wdnt be binding on the President. 4. A modified Bill is presented in the two houses of Sansad Bhavan which requires just a simple majority to clear the bill. 5. 84th CA- Jhar, Chhatis, Uttra, 113th CA- Orissa-Odisha, Oriya-Odiya) 6. Articles 2,3,4 relate with the formation, altercation of names/boundaries. Telangana was formed without amending the Cn since art 3 does not need a CA under Art368 requiring a special majority. A simple majority wd do. In Telangana’s case now the centre needs to move amendments to 371D & E to ensure the benefits of the special provisions of these articles to both Andhra and Telangana.
