THE ORIGINAL AND TRUE TEXT OF SEC. 304.5.b OF THE 2004 REVISED IRR OF P.D. NO. 1096 (1977 NBCP) AS PUBLISHED THRICE IN 2005 BY THE DPWH : SECTION 304. Issuance of Building Permit xxx 5. Terms and Conditions of Permits The issued building permit shall be subject to the following terms and conditions: a. xxx b. This permit SHALL BE ACCOMPANIED by the various applicable ancillary and accessory permits, plans and specifications signed and sealed by the CORRESPONDING design professionals who shall be responsible for the comprehensiveness and correctness of the plans in compliance to the Code and its IRR and to all applicable referral codes and PROFESSIONAL REGULATORY LAWS. (emphases supplied) Annotation: Per recent Supreme Court issuances, the IRR is in effect the law insofar as it does NOT contradict the spirit, meaning and intent of the enabling law. It is clear from the above provision (Sec. 304.5.b.) under the 2004 Revised IRR of P.D. No. 1096 (the 1977 NBCP) that the Local Building Officials (LBOs) are EXPRESSLY mandated to ENSURE compliance with professional regulatory laws (PRLs) such as R.A. No. 9266 (The Architecture Act of 2004), specifically its Sec. 20.5 that mandate that only registered and licensed architects/ RLAs shall sign and seal ARCHITECTURAL documents, already defined under the 2004 IRR of R.A. No. 9266. Please note that Sec. 304.5.b. of the 2004 Revised IRR of P.D. No. 1096 (the 1977 NBCP) was apparently DELETED in the privately-published/ commercially available version of said IRR.
