THE TRINITY OF INFAMY: Three Legal Stalwarts are in the news for the wrong reasons! The Attorney Generals of Lagos, Rivers and Nassarawa States are in the headlines for very controversial reasons. The Chief Law Officer of Lagos was not happy that a Court of Law of competent jurisdiction held that the State Government had no locus or basis to collect toll gate rates from hapless citizens. Annoyed with the verdict the learned AG instead of going on appeal, insists that the Toll Taking must continue! His reason the court merely declared the collection of the rates illegal, without a consequential order! I wonder how the mind of the learned AG is working, if a Court declares an act illegal does the court need to make a specific order consequent upon the declaration for the Lagos State Govt to cease fire? Has the AG forgotten that declaratory judgement have effect and do not need consequential reliefs to be granted to make it potent? Has the Learned AG adverted his mind that should any breach occur that he cannot drag a party to court for defaulting since law doesnt support a base cause, an illegal act cannot sustain a cause of action! Mr Boms in Rivers State in line with his constitutional powers entered a nolle prosequi to terminate the trial of Mr Lloyd the Deputy Speaker who in front of the camera almost murdered the victim of his rage! The Learned AG says there is no evidence. Very lame excuse! Is he not aware of the tapes which were on television and its contents shared on the net? If we are to ascribe his stupid excuse to want of evidence, I am tempted to ask wasnt he aware of the dearth of evidence when the information was filed? Or is he saying that he was playing to the gallery by dragging Lloyds to court? This excuse further rubbishes his battered image! In far away Nassarawa, a hardworking AG had to scale through the fence to serve a court process on members of the parliament! One wonders what on earth would have made the AG stoop so low to jump the fence, is it overzealousness? Desperation? Love for the Job? Is there more to it that meets the eyes? Me thinks that whatever emergency he was trying to nip in the bud would be taken care of by litigation. Where went the Bailiffs? Where went the juniors in the ministry who could assist in the service, what of the Ministrys admin staff who could help to serve?...... Is Substituted Service alien to their rules of court? Why would my learned AG do an Agama Lizard to do his job?......... These 3 Chief Law Officers are the talk of the town for the wrong reasons!
