THIS IS HORSESHIT!!! Trooper was driving distracted. Any regular citizen doing this would have got a fine 5x higher, and at least double the license suspension. Almost unbelievable neither on the motorcycle died, considering the speed at which they were hit. XENIA — An Ohio Highway Patrol trooper who pleaded no contest to a citation after rear-ending two people on a motorcycle with his law enforcement cruiser was sentenced Monday to a six-month license suspension. Seth Tieger, an assistant Hamilton County prosecutor assigned as a special prosecutor in the case, recommended Trooper Jacob M. Daymon, 30, be charged with failure to maintain assured cleared distance (failure to stop a vehicle to avoid a crash) — a misdemeanor. The citation was filed in Municipal court on Oct. 21 after a Greene County grand jury declined to indict on felony charges. Daymon was also fined $150 and ordered to pay court costs. His attorney said he will have to apply to have the license suspension lifted for his drive to and from work and driving a state patrol cruiser. The citation is related to a Aug. 17 incident where Daymon struck Corey and Amy Waldman, of Beavercreek, who were traveling west on U.S. 35 in New Jasper Twp. The Waldmans were treated and released at Miami Valley Hospital. According to court records, Daymon told a supervisor he was on his way to work at the Xenia post when he was dispatched to U.S. 35, near the Jamestown exit, for a report of a pedestrian walking in the highway. Daymon radioed to dispatch that he was unable to locate the pedestrian. Daymon told the supervisor he was using his mobile command terminal, a laptop mounted between the front seats, to clear himself from the incident when he struck the motorcycle from behind, according to court records. He stated he never saw the motorcycle until the riders were striking the windshield, according to the supplemental incident report included in the court file.
