THIS WEEK IN TRANSPORTATION, Nov. 25, 2014: Ethics Complaint Filed Against Mike Regan; NASSTRAC Rejects 12PL ‘Rate Transparency’ Ad; AIPBA Retains ARENT FOX to handle DOJ Antitrust Complaint; Class Action Collusion Suit Against TIA Contemplated… NASSTRAC/NITL Member James Lamb has filed a complaint with NASSTRAC and NITL asking they determine whether NASSTRAC “Advocacy” Chair/NITL Member of the Board of Directors Mike Regan’s TransAct/TIA video referenced below, which is currently being disseminated publically on Youtube, constitutes an Ethics Violation since Lamb is a member of NASSTRAC and Regan is supposed to be “advocating” for its members. Lamb indicated Regan had emailed him multiple times within the past week complaining to Lamb that Regan was referenced in last week’s “This Week in Transportation” newsletter that covered the NITL event. According to the emails, Regan suggests Lamb owed Regan “professional courtesy” because Regan offered out his hand to Lamb at the NITL conference last week right before the NITL Board election. However, in a complaint to NASSTRAC’s Executive Director Gail Rutkowski, Lamb stated: “I am wondering if NASSTRAC condones this video put up by NASSTRAC Advocacy Chair Mike Regan that targets me, a NASSTRAC member? https://youtube/watch?v=cGktA7UqYVQ Your mission is supposed to be: “... the leading provider of advocacy, education, connections, and solutions to transportation and logistics professionals who manage freight across all modes” Lamb also expressed concern that NASSTRAC was blocking his ad to other NASSTRAC shipper members, in which he offers shippers “rate transparency” as 12 Percent Logistics (12PL; see: twelvePL): “I note also that NASSTRAC declined to publish my ad to shippers that markets the new rate transparent brokerage I manage called 12PL… Just how is NASSTRAC advocating for me and connecting me and my transparent solution?” In a recent email to 12PL, Rutkowski had wrote: “We would like to thank you for your interest in advertising with our association. While we occasionally accept e-blasts from non-members, it is our judgement (sic) the e-blast in question is not a good fit for our organization.” Even after Rutkowski was subsequently advised that 12PL was actually one of her NASSTRAC members, she still rejected the ad. It appears NASSTRAC is following the TIA’s lead in attempting to protect the megabroker 3PLs from competition from transparent brokers.
