THREE FEATHERS CASINO TRIAL COVERAGE - indictment dismissals Judge dismisses illegal gambling indictments against two Hogansburg men. - Watertown Daily Times A federal judge on Wednesday dismissed indictments against two men charged with operating an unsanctioned casino on the St. Regis Mohawk Reservation. Senior U.S. District Court Judge Thomas J. McAvoy, Binghamton, dismissed indictments against Anthony Laughing Sr. and James Gray, both of Hogansburg. Court documents do not show the reason for the dismissal of the indictments against Mr. Laughing and Mr. Gray. However, Mr. Laughing’s attorney, Donald T. Kinsella, Albany, wrote a letter to Judge McAvoy on Tuesday saying that Mr. Laughing suffers from numerous health issues and that he and Mr. Laughing “have no confidence in his ability to sit through another lengthy trial in the near future, and there is little likelihood that his condition will ever be good enough to tolerate a criminal trial” in the matter. Prosecutors requested that the indictments be dismissed “after considering all of the circumstances of this case and in the interest of justice,” according to a motion to dismiss filed Wednesday. Mr. Gray has consistently been identified in court documents as a fugitive and was never arraigned on the two charges in the indictment: operation of an illegal gambling business, and transportation, possession and use of gambling devices within Indian country.
