TRIBUNAL STOPPED By: Eric Tarman The Prime Minister has managed to temporarily stop a Leadership Tribunal set up to investigate allegations of misconduct against him, from going ahead. This is after the National Court in Waigani granted orders in Peter ONeils favour yesterday (Thursday 08-01-15), to put the inquiry on hold, while the Supreme Court, deal with some Constitutional issues which were raised. The Ombudsman Commission referred Mr ONeil to the public prosecutor on August 11 2014. But the public prosecutor refer the matter back to the commission for further evidence before he made his decision. Mr ONeils lawyer, Queens council Val Varitimose submitted that the public prosecutor had not constitutional authority to go back and ask the Ombudsman Commission for further evidence, adding this was wrong in law. He also argued that the public prosecutor had no constitutional authority to amend the allegations that is having added to and further dropping two. Justice Cannings said, the prime minister has an arguable case because the questions are serious and relevant and required the supreme courts interpretation.
