Whereas there have been a subtle understanding by counsel to all the parties, Iyiola Omisore, PDP, Rauf Aregbesola, APC, and INEC, as guided by the tribunal panel, during pre-hearing when the petition was commencing, that all certified documents desired to be submitted before their Lordships shall be allowed to gain tendering, and where objections arise it will be defer till final address stage! But all the Respondents Counsel except the INEC aside this gentleman agreement today by the time PDP forensic Expert wanted to begin the analysis of all the contentious ballot papers from the 17 local government areas which are being challenged by Senator Omisore. Lawyers to Rauf Aregbesola and the APC had vehemently kicked against the analysis by the Forensic Expert hired by Omisore citing different sections of the evidence act and varied authorities. Alex Iziyon SAN-Counsel to Iyiola Omisore was however un-rattled. The PDP Counsel rose on several legal backings and authorities such as section 82 sub 2 of the evidence act, constitutional reference, and authorities like Oba Tejuosho and Others versus Dr Majekodunmi. My consternation in all of the above is why Ogbeni Rauf Aregbesola whom Chief Iyiola Omisore continues to describe as an Acting Governor will not want the Forensic analysis explained in court as contained by Witness Statement already forming evidence before the Tribunal? Did Aregbesola truly win with this conduct of his legal team? Meanwhile, In the unanimous ruling of the Court under Justice Elizabeth, the Subpoena issued by the Tribunal on the INEC and all the controversial ballot papers has been adopted by the court in evidence in line with the prayer made by the PDP Counsel. Ruling has however been adjourned till the final address stage. By implication, The Forensic Expert must testify whether APC or Anybody likes. Trooping out from inside the court after the judge granted an Hour break, Counsel to Iyiola Omisore-Alex Iziyon SAN told the press that they are okay with the proceeding and declared that the court is in charge. Counsel to Rauf Aregbesola-AkinOlujinmi SAN told reporters that We are uncomfortable. Jamiu Olawumiof the OSBC was on the ground.
