Just fold them individually and write the Alderman’s name on the outside, and stuff them all in. City Hall will distribute them. The Mayor has been appointed Vice President of The Tennessee Municipal League, a voluntary group of mayors from all over the State. It was established by the cities and towns of the State for mutual assistance and improvement. The Leagues primary function is to work with the Tennessee General Assembly on legislation. Please call, write, and fax them and ask them to help Mayor Holden resolve Beau’s case and to advise him that the City Ordinance is not legal under State Law. The Message Team Beau, as you may recall, Beau was given a stay of the Order directing his euthanasia by the Circuit Court on November 20, 2014. Ever since, Beau has been protected by this Stay. Yesterday, January 21, 2015, the City filed in Circuit Court a Motion to Vacate Stay TO ALLOW THE CITY TO IMMEDIATELY EXECUTE ITS JUDGMENT THAT BEAU IS VICIOUS AND MUST BE EUTHANIZED. The only reason to file this Motion is to be able to kill Beau. Obviously just the evening before, one of the City’s Attorneys told the Board of Aldermen that Beau is safe and being well cared for and that Beau can still be adopted. This Motion has not yet been set for hearing and we will obviously oppose it. However WE NEED YOUR HELP. THIS MAY BE OUR LAST CHANCE TO SAVE BEAU. PLEASE WRITE THE MAYOR AND THE BOARD OF ALDERMEN AND ASK THEM TO DO ONE OF TWO THINGS: EITHER VOTE TO REPEAL THE VICIOUS DOG ORDINANCE that is against Tennessee law and is unconstitutional anyway, or VOTE TO WITHDRAW THE CHARGES AGAINST BEAU AND MR. HIGGINS, then the court will dismiss the case with prejudice. THE TIME FOR ACTION IS NOW. Please write and call all the Aldermen and the Mayor. Also please write to the Tennessee Municipal League, they can help. Let people know that this has gone on for over 3 months. This needs to end, today. Let Beau GO!!! After reviewing the Tennessee Code Annotated (TCA) it appears as though the city is not following state law. Simply because under the (TCA), a city within Dyer county is not able to create its own ordinances for this matter. Please remember, Tennessee is a Dillons rule state, meaning that unless it is a Home Rule municipality, state law applies. This is the case with Dyersburg, their vicious dog ordinance conflicts with state law. Also, just think about how many other animals have been impacted that shouldnt have been?! This is VERY important, especially with the upcoming court hearing City Court that was to be on January 27th has been moved to February 3rd at 4:00 in the Municipal Building at 435 West Market St. THANK YOU.
