Terms and Conditions The Life For Democracy Survey [the “Democracy Survey”] is organized by the Life for Democracy Committee [the “Organiser”].The Democracy Survey is for the purpose of understanding the democracy level of Malaysian. The questions have been reviewed and certified by Malaysia lawyer 1. Duration 1.1. The Democracy Survey shall start from 15th September 2013 and end on 15th December 2013. 1.2. The Organiser may at its sole and absolute discretion extend or change the Democracy Survey period at any time without any prior notice. Any participation during the Democracy Survey or during the extended Democracy Survey Period (if any) shall be governed by these terms and conditions ["Terms and Conditions"] which shall remain in full force and effect. 1.3. The Organiser may at its sole and absolute discretion withdraw this Democracy Survey without any prior notice, and without any compensation to any Participant. 2. Eligibility 2.1. The Democracy Survey is open to all Malaysian citizens at the time of participation [hereinafter collectively referred to as “Participant”]. 3. Participation Mechanics & Qualifying Criteria 3.1. One Malaysian citizen is only entitled to one entry. A Participant with more than one entry will void his participation into the Democracy Survey. 3.2. All participants must answer all the 14 questions in the Democracy Survey. Failing to do so will void his participation into the Democracy Survey. 3.3. The Democracy Survey offers several prizes as specified on the Life for Democracy Facebook Page. 3.4. The Organiser reserves the right to reject any Participant at its sole and absolute discretion without having to assign any reasons whatsoever. 3.5. The Organiser nor any other parties involved in the Democracy Survey shall be liable in any way for delays and/or interruptions occurring within the Democracy Survey sessions. 4. Notification of Winners 4.1. The winners of Democracy Survey will be announced “live” and displayed on Life for Democracy Facebook. 4.2. The Organiser reserves the right to use any other method or medium it deems fit at its sole and absolute discretion for the purpose of announcing the Winners. 4.3. The Organiser will not be held liable in the event the Winners cannot be contacted for whatever reasons after at least three (3) attempts. 4.4. Should the stipulated condition in 4.3 expire, the Prize related to the given draw will be re-entered into the Democracy Survey for other Winners. 4.5. Participants are advised to be in the vicinity of the whereabouts of the Democracy Survey. 4.6. Winners will be required to answer some of the questions listed in the survey to ensure that no cheating in the survey. 4.7. Winners will be required to provide certain details in order to prove their identity upon collecting their Prizes. 4.8. The Organiser reserves the right to forfeit prizes for any Winner who does not provide the required details upon receiving the request/notification. 4.9. The Organiser reserves the right to appoint a third party to conduct the verification of Winners and to fulfill the delivery of prizes. Participants agree that the Organiser may provide all necessary information of Winners to such third parties to facilitate such service. 5. Liability & Responsibility 5.1. Participants and Winners shall assume full liability and responsibility in case of any liability, mishap, injury, damage, claim or accidents [including death] resulting from their participation in the Democracy Survey, redemption and/or utilization of the prizes and agree to release and hold the Organiser and its prize partners free and harmless of any liability. 5.2. All transportation, accommodation, personal costs and/or any other costs, fees and/or related expenses that are incurred to participate in this Democracy Survey and to redeem their prize are the sole responsibility of the Participants/Winners. 6. Rights of the Organiser 6.1. The Organiser shall reserve the right to use the names and/or photographs of the Winners as materials for the purposes of advertising, trade and/or publicity, without any prior notice to the Winners and the Winners shall not be entitled to claim ownership of compensation on the materials. 6.2. By participating, the Participants hereby expressly agree to be bound by these Terms and Conditions and the decisions of the Organiser and/or the judges. The Participants hereby give their consent to and authorize the Organiser to disclose their particulars to the third party service providers and/or partners engaged by the Organiser for purposes of the Campaign and/or any customer survey in understanding Malaysia democracy level. 7. Terms & Conditions (Official) 7.1. The Organiser’s decision on all matters relating to the Democracy Survey shall be final and binding and no further correspondence or attempt to dispute such decision would be entertained. 7.2. The Organiser reserves the rights to change, amend, delete or add to those Campaign Terms and Conditions without prior notice at any time and the Participants shall be bound to such changes. 8. Prizes 8.1. There is no right or wrong answer as to the first 13 question in the Democracy Survey. 8.2. The prizes are given to the participants of best answer based on the question no.14. The Organiser’s decision on all matters shall be final and binding and no further correspondence or attempt to dispute such decision would be entertained. 8.3. Prizes are based on list provided by Life for Democracy. 8.4. Each Participant is only entitled to win ONE (1) prize. 8.5. The Organiser reserves the right to substitute any of the prizes with that of similar value at any time at their absolute discretion without prior notice and all prizes are non-transferable to cash and non-negotiable. 8.6. The Winners shall be responsible for all costs in connections with collecting his/her prize, including but not limited to legal cost, stamp duties, registration and transfer fees, taxes, insurance, spending money and related expenses (such as meals or personal expenses, upgrades etc.) or fees. 8.7. The Organiser makes no warranties or representations whatsoever with respect to the prize and shall not be responsible nor liable for any problems and/or damage thereto or arising there from. 8.8. Prizes must be claimed in person unless advised otherwise. Identification which includes IC/driver’s license/Passport which displays a photograph of the Winner will be required. Where the Organiser elects to post/courier a prize to a Winner no responsibility will be accepted by the Organiser for the safe and effective postal delivery of the prize. 8.9. In special situations, and subject to the absolute discretion of the Organiser, a Winner may nominate a designated representative to collect a prize. The representative will be required to present written authorisation from the Winner and photocopy of Campaign Winner IC (front & back). 8.10. In the event that a Winner chooses not to accept a prize, they forfeit any and all claims to that prize, which will be dealt with according to the absolute discretion of the Organiser. 8.11. All prizes are accepted entirely at the risk of the Winner, and the Organiser excludes all warranties in connection with any prize to the extent permitted by law. Winners shall comply with the terms and conditions of the prize. Disclaimer The Democracy Survey Campaign have been translated into Chinese, Malay and Tamil. In case of discrepancies between the English version and other versions, the English Version shall prevail.
