Deciding which State will be your legal residence is just one of the big questions that must be answered. Everyone must have a “domicile”. If you sell your home and live in your RV fulltime, the RV is not your domicile, it is your residence. If you have sold your home, the State where you lived in the home will be considered your domicile until you make the effort to choose another State as your domicile. Making the effort calls for intent. If you intend to become a Texan you will do some things to indicate your intentions. You may register your vehicles, register to vote in Texas, lease an apartment or RV lot. You may also apply for a Texas driver’s license. In order to do these things you would need an address in Texas. Texas laws have recently changed excluding “a private mailbox address” from being considered a “domicile”. Texas House Bill No. 2730 Section 521.1426. Domicile Requirement, Verification “The department may not issue a driver’s license or a personal identification certificate to a person who has not established a domicile in this state.” Sec. 521.1427. “Post Office Box Not Valid As Address (a) In this section, “post office box address” means a United States Postal Service post office box address or a private mailbox address.” Because the laws have changed, the address assigned by Texas Home Base is not considered a domicile and can’t be used on a Texas Driver’s license. It can be used as the “Mailing Address”. If you lease an RV lot for a length of time in Texas that address could possibly serve as your domicile. There are many fulltimers who come back to the same RV park or campgrounds intentionally once a year to establish their domicile in Texas. They may travel throughout the year, using the mailing address issued by Texas Home Base, no matter where they are. A person would register vehicles and register to vote in the county they have determined to be their domicile county. A person can apply for a Texas driver’s license in any Texas town that has a DPS office. This is only information. Consult a lawyer for legal advice.
