That by the terms of the said contract this plaintiff was to take care of the individual lots of purchasers thereof in the cemetery, and do certain work thereon in the way of keeping them lawn mowed, keeping them clear of all sticks, stones and rubbish, etc., for which work this plaintiff was to receive one-half the price thereof, which when collected "by the defendants was to be paid over to him. (If the family defaulted on the annual care fee and the cemetery did NOT collect the fee he may not have received his half even though he did the work) That by the terms and conditions of the said contract It was the duty of the defendants to collect from the various persons owing the same the various sums of money due for labor performed by this plaintiff for them in and about their lots in the cemetery grounds.
