It is important to point out that the R/S Local govt Law provides for 3years tenure and any attempt to abridge that will entail the amendment of that law by the N/Assembly as any other step will render it illegal. As regards the pronouncement of the court on Fair Hearing alone. It is the law that once any act provided by law negates Fair Hearing, the court does not bother delving into any other issue. Hence, the reason for not bothering whether the RHSA has the power to suspend or not. Read Amadi v NNPC
