“The Applicant has not established any causal link or any non-speculative adverse impacts.” Speculation is a word that recurs an awful lot in the government’s submission, and it’s mostly used to address the claim that the FIPA with China will affect First Nations’ land and resources — and specifically that of the Hupacasath. It takes on that claim in plenty of ways, the simplest of which is the fact that the Chinese don’t have any investments in Hupacasath territory — all of which is located in B.C. — and that the ability of a Chinese investor to sue the Canadian government for a breach of the FIPA requires, intuitively enough, that they have an investment to protect in the first place.
